I provided the debt collection company with written proof that the property manager did not try to rent out the unit I vacated. They actually said they tried to rent out units that were vacant longer first. Without a concern for the truth and validity of the information I provided them, they still tried to collect the debt. Rental cost after the tenants have vacated are only collectible under California Civil Code 1951.2 if there is an attempt to re-rent the unit. My assumption is that they try to rent out units that do not have anyone under contract. In our case, they didnt even list our unit as available online for several weeks.
