Consumer Narrative
Complaint Type : Failure to Block Fraudulent Information Identified as Resulting from Identity Theft Summary of Complaint : I am filing this complaint against Equifax for failure to comply with the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S.C. 1681c-2, which requires credit reporting agencies to block identity theft-related information within four business days of receiving a valid identity theft report. On multiple occasions, I informed Equifax in writing that the following accounts on my credit report were the result of identity theft. I submitted a valid FTC Identity Theft Report ( FTC # XXXX ), along with a copy of my government-issued ID and Social Security card , as required by law. Despite this, Equifax failed to block or remove the following fraudulent accounts, which continue to damage my credit and prevent me from obtaining essential housing for my children : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Additionally, unauthorized hard inquiries remain on my Equifax report , even after proper notice and documentation XXXX XXXX XXXX Despite more than 60 days having passed, I have not received any proof of a proper reinvestigation or the required block. My repeated follow-up communications have been ignored or responded to with generic notices stating the accounts are " verified as accurate, '' without any documentation. Legal Violations Involved : 1. FCRA 1681c-2 ( a ) ( 1 ) : Failure to block fraudulent information identified by the consumer within 4 business days after receiving an identity theft report. 2. FCRA 1681i ( a ) ( 1 ) ( A ) : Failure to conduct a reasonable reinvestigation upon dispute. 3. FCRA 1681c-2 ( c ) : Failure to maintain the block for one year, with option for consumer to extend. 4.
