This complaint is not a duplicate. It is an escalated continuation of an unresolved dispute regarding an account with XXXX XXXX that involves confirmed identity theft and ongoing, willful violations of the Fair Credit Reporting Act ( FCRA ). I have submitted over 10 identity theft reports to XXXX XXXX, including : An official FTC Identity Theft Report, A notarized sworn identity theft affidavit, XXXX own internal fraud documentation packet, fully completed, A personal statement confirming I never opened the account, authorized the loan, or allowed any associated party to do so. Despite overwhelming documentation, XXXX XXXX has : Failed to block the fraudulent account under FCRA 605B, Failed to delete or modify the account under 611 and 623, Continued to report re-aged and unverifiable data in violation of 1681c ( a ) ( 4 ) and 1681s-2 ( a ) ( 1 ) ( A ), Ignored multiple written disputes over several years, showing a pattern of willful negligence and reckless disregard for my rights under federal law. To this day, the XXXX XXXX account ( auto loan opened XX/XX/year> ; account ending in XXXX ) remains on my credit report. It continues to display inaccurate payment history, illegal charge-off reporting, and no valid documentation supporting the debt even after years of formal disputes and identity theft notifications. This complaint is not about a simple dispute it is about prolonged, systemic noncompliance with identity theft handling under FCRA : FCRA 605B ( 15 U.S.C. 1681c-2 ) : Furnishers must block identity theft accounts within 4 business days after receiving a proper identity theft report. XXXX has failed this over 10 times. FCRA 611 ( a ) : XXXX and the CRAs must reinvestigate and delete unverifiable data. This has not occurred. FCRA 623 ( a ) ( 3 ) and FDCPA 1692e ( 8 ) : If the account is marked as verified and not flagged as disputed, that is deceptive and unlawful. I have reached the point of procedural exhaustion. I am respectfully demanding : Immediate deletion of the XXXX XXXX account from all consumer reporting agencies, A formal supervisory investigation into XXXX handling of identity theft complaints, Consideration of civil penalties and enforcement under FCRA XXXX for willful noncompliance. This account does not belong to me. The company has had ample opportunity to correct it. I am requesting the CFPB escalate this matter immediately. I attached the most recent complaints, to cfpb and XXXX, but that would be too many to attach, the complaints and their associated ID 's can be found by XXXX and CFPB
