I am filing this follow-up complaint against Equifax because the previously disputed and deleted account XXXX XXXX XXXX ( Account # : XXXX ) has once again reappeared on my credit report. I am beyond frustrated and disappointed that Equifax continues to violate the Fair Credit Reporting Act ( FCRA ) with no regard for accuracy, transparency, or consumer rights. This account was originally reported in XX/XX/year> and deleted in XX/XX/year> after I successfully disputed it. In reviewing my most recent credit report, I discovered that it has been reinserted without any written notice, without my consent, and without a single piece of documentation provided to support the reinsertion. This is not only unacceptable but a clear and repeated violation of the FCRA. Under 15 U.S.C. 1681i ( a ) ( 5 ) ( B ), Equifax is required to notify me in writing within five business days if a previously deleted account is reinserted. That never happened. Under 15 U.S.C. 1681i ( a ) ( 5 ) ( C ), reinsertion must be based on new and verified documentation from the furnisheragain, none has been provided. Lastly, 15 U.S.C. 1681e ( b ) requires Equifax to ensure the maximum possible accuracy of the data it reports, and allowing a disputed, deleted, and unverified account to resurface directly violates that standard. This is now a pattern of negligence and noncompliance. I am demanding that the Consumer Financial Protection Bureau ( CFPB ) take action immediately. Equifax must delete this account from my credit report once and for all, provide all documents they allegedly received to justify the reinsertion, and send me written confirmation along with an updated report. I also ask that the CFPB investigate Equifax for willful and negligent noncompliance under 15 U.S.C. 1681n and 1681o, and pursue all appropriate enforcement measures. Im tired of having to chase down basic compliance and corrections for errors that should never have happened in the first place.
