I am submitting this complaint against Comenity Capital Bank for their continued and unlawful reporting of a closed, sold, and securitized credit accountdespite having no legal authority, ownership interest, or servicing role in the account. The account in question is a Forever XXXX Credit Card, ending in XXXX, which was charged off on XX/XX/year>, and sold to XXXX XXXX XXXX on XX/XX/year>. However, prior to both the charge-off and the sale, the receivables associated with this account were securitized into an asset-backed trust, as disclosed in Comenitys own SEC filings ( XXXX and prospectus documents ). This means Comenity relinquished all ownership rights and financial interest in the account at the time of securitization. After that, they acted only as a servicer, and once the account was sold to a third party, they ceased even that role. They are no longer the creditor or the data furnisher with legal standing. Despite this, Comenity continues to report the account under their name to credit reporting agencies as a charge-off, with a XXXX balance, also by their own admission on their letter head and on my consumer report, expressed they have sold the account to a third party, but the fact that they are still reporting this account under their company name, they are implying they are still the creditor, or have authority over the debt. This is false, deceptive, reporting an account you no longer own constitutes as intentional deception, and violation under 15 USC 1681s-2 ( a ) ( 1 ) ( B ). I sent them several cease-and-desist letters demanding that they stop reporting this account and delete the tradeline. They refused to correct the issue, they claim it is their policy to comply to applicable laws and regulations, I know that Comenity Capital Bank are aware they are no longer the holder of this debt or account, they relinquished all of their rights over this account when the account was sold and they no longer have a financial interest, so why would they continue to report this account under Comenity Capital Bank name. I believe this violates multiple federal consumer protection laws, including : FCRA 623 ( 15 U.S.C. 1681s-2 ) for furnishing inaccurate information FCRA 604 ( 15 U.S.C. 1681b ) for accessing/using consumer reports without a permissible purpose FDCPA 1692e for false or misleading representations Gramm-Leach-Bliley Act for misusing or mishandling consumer financial data As a result of their actions, I have suffered credit denials, emotional distress, and loss of access to housing, vehicles, and other financial opportunities. This is actively harming my ability to move forward in life. I respectfully request that the CFPB investigate Comenity Capital Bank for furnishing inaccurate and unauthorized credit information. I also request that they be compelled to delete this tradeline from all consumer reporting agencies and cease all further reporting on this account. This situation is unjust, unlawful, and harmfuland it must be corrected.
