Formal Complaint and Criminal Investigation Request Retaliatory Credit Reporting and IRS Violations by XXXX XXXX XXXX -Equifax Report Confirmation : XXXX CFPB Case No. : XXXXDate of Letter from XXXX : XX/XX/XXXX. I am requesting that the CFPB forward this matter to the IRS Criminal Investigation Division and initiate a formal review of XXXX XXXX XXXX ( XXXX ) for potential violations of federal tax law under 26 U.S.C. 6050P and continued retaliation through credit reporting misconduct, in violation of the Fair Credit Reporting Act ( FCRA ). According to the letter I received from XXXX dated XX/XX/XXXX, the company affirms that my account has been charged off with a balance due. Yet, they simultaneously claim that no IRS Form 1099-C was issued because the debt is not considered canceled or forgiven. This position is inconsistent with federal tax code and may constitute willful misrepresentation of the status of the debt for tax and credit reporting purposes. Further, despite this account being closed and charged off in XXXX, XXXX XXXX XXXX continues to update and reinsert the account into my Equifax credit report as of XX/XX/XXXX, without providing certified reinsertion validation or notification. This is a violation of FCRA 1681i ( a ) ( 5 ) ( B ) and may constitute unlawful re-aging of a derogatory tradeline. Under FCRA 1681e ( b ), all information reported must be accurate and not misleading. Reporting a charge-off while maintaining a balance and describing it as Profit and Loss misrepresents the legal and financial status of the account. If the debt was written off, a 1099-C is required. If not, it should not be reported as a charge-off or profit/loss. XXXX can not have it both ways. In light of XXXX conflicting statements, continued updates, and refusal to follow proper procedures after prior disputes, I request that this matter be referred to : The IRS Criminal Investigation Division for willful violation or evasion of IRS 6050P requirements, And that the CFPB conduct a full enforcement review for retaliation, improper credit reporting, and continued FCRA violations. The enclosed letter dated XX/XX/XXXX, from XXXX XXXX XXXX is submitted as new evidence. I respectfully request that CFPB take action, refer this to appropriate regulators, and ensure the permanent deletion of this account from my credit report if XXXX can not legally validate it under current law.
