Consumer Narrative
Product : Credit card or prepaid card Issue : Improper sharing of personal information Company : Discover Bank What happened? I am filing this complaint to report serious concerns regarding Discover Banks handling of consumer personal information, including the unauthorized exposure and transfer of Social Security numbers and other sensitive personal data during the sale of delinquent accounts to third-party debt collectors. Discover Bank appears to sell or transfer account data to debt collectors without adequate data protection, resulting in third parties gaining access to personally identifiable information ( PII ) such as my full name, address, date of birth, account numbers, and Social Security number. Furthermore, these debt collectors often pose as legal representatives of Discover Bank, using misleading tactics to coerce or threaten repayment. In doing so, they create confusion, cause emotional distress, and may violate both the Fair Debt Collection Practices Act ( FDCPA ) and Fair Credit Reporting Act ( FCRA ). This practice raises serious concerns about : Lack of proper disclosure about how personal data will be used once an account is charged off or sold. Potential violations of federal privacy laws. Deceptive practices by debt collectors who falsely represent themselves as attorneys or legal agents of Discover Bank. I am requesting the CFPB to : Investigate Discover Banks data-sharing policies with third-party collectors. Require Discover Bank to cease sharing sensitive PII without consumer consent or adequate protection. Hold both Discover Bank and associated debt collection agencies accountable for any gross negligence, deception, or privacy violations. Desired resolution Stop the dissemination of personal information to unauthorized third parties. Provide full disclosure on what information is being shared and to whom. Require Discover Bank to issue formal documentation to consumers when an account is sold, specifying the new owner of the debt. Require immediate disciplinary action or penalties if found in violation of privacy or consumer protection laws.
