Upon carefully reviewing my credit reports, last week in XX/XX/XXXX, I identified serious inaccuracies involving two XXXX XXXX XXXX accounts : XXXX XXXX XXXX account ending in XXXX ( opened XX/XX/XXXX ) reported balance : {$2800.00} XXXX XXXX XXXX account ending in XXXX ( opened XX/XX/XXXX ) reported balance : {$13000.00} Both accounts are reported as charged off and closed ; however, there are numerous material and legal deficiencies in the reporting, including : Inaccurate balances still being reported post-charge-off despite no record of sale or lawful assignment. Account statuses improperly updating monthly, even after charge-off, falsely suggesting active collection or new activity. Incorrect and inconsistent dates for last payment, charge-off, and account activity. No indication of transfer to another entity, violating Metro 2 credit reporting guidelines and FCRA 1681s-2 ( a ). I have contacted XXXX XXXX XXXX repeatedly. I was transferred among various departments and external collection companies, none of which have any record of these accounts. This further proves that the tradelines are inaccurate, unverifiable, and materially misleading. Furthermore, both accounts are currently the subject of active litigation, and I have already filed a XXXX XXXX XXXX XXXXXXXX pursuant to the original cardholder agreements, which contain binding arbitration clauses. Despite this, XXXX XXXX XXXX continues to furnish negative, disputed information to consumer reporting agencies, violating FCRA 1681i ( a ) ( failure to reinvestigate disputed information ) and 1681e ( b ) ( failure to maintain maximum possible accuracy ). The ongoing reporting during an active arbitration proceeding is unlawful and prejudicial. Under the case law Cushman v. Trans Union Corp.XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, furnishers and credit reporting agencies must conduct independent, meaningful investigations and can not blindly parrot previously furnished information. Additionally, continuing to report outstanding balances and updating statuses monthly, without identifying any lawful transferee or validating the accuracy of the debt, also constitutes false representation of the character, amount, or legal status of the debt, in violation of the Fair Debt Collection Practices Act ( FDCPA ) 1692e ( 2 ) ( A ). These errors are materially harming my credit profile, artificially lowering my scores, and obstructing my ability to secure mortgage financing and other necessary credit opportunities. I am requesting immediate deletion of both accounts due to FCRA violations, FDCPA violations, pending arbitration proceedings, and the failure to comply with Metro 2 industry reporting standards.
