Consumer Narrative

RE : Formal Demand for Deletion of Inaccurately Reported Charged-Off Account Account No. Ending in XXXX To Whom It May Concern, I am writing to notify you of serious and ongoing violations of the Fair Credit Reporting Act ( FCRA ) in relation to your reporting of the account ending in XXXX, originally opened on XX/XX/XXXX. This credit card account is currently listed as closed and charged off, yet your company continues to furnish misleading and inaccurate information to the consumer reporting agencies. The violations include : Monthly charge-off reporting after the account was closed. The account was charged off, yet you continue to report it as if it is actively delinquent. " CO '' has been reported for 20 consecutive months from XX/XX/XXXXXXXX through XX/XX/XXXX, which is misleading and a direct violation of FCRA Section 1681s-2. Re-aging of the account. Reporting ongoing charge-offs after the original charge-off date gives the false appearance of a more recent delinquency and may artificially extend the reporting period. This is deceptive and violates credit reporting standards. False reporting of the account status. The account is closed, yet the credit history reflects continuing negative activity, which is inaccurate. Failure to finalize derogatory status. Charged-off accounts should reflect a fixed derogatory status and should not continue accumulating new derogatory marks after the charge-off date. These actions constitute 23 separate violations of federal law. As allowed under the FCRA and FDCPA, each violation is subject to statutory damages of up to {$1000.00}. Therefore, I am seeking a total of {$23000.00} in damages. You are hereby given 15 calendar days from the date of this letter to remove this account in its entirety from all consumer reporting agenciesand provide written confirmation of the deletion. If you do not comply within this time frame, I will proceed with formal complaints to the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and my State Attorney Generals office. I will also initiate legal action to seek statutory damages, attorneys fees, and any other relief permitted by law. This letter serves as your final opportunity to resolve this matter without legal escalation. Sincerely,
