As the fiduciary of the XXXX XXXX XXXX XXXX ( IRS Form 56 on file with the IRS ), I lawfully notified XXXX XXXX and their legal representative, XXXX XXXX XXXX, that all correspondence regarding any alleged accounts must be directed to me in my fiduciary capacity. I formally requested full validation of the alleged debt, including the original signed agreement and complete account history. A XXXX XXXX representative confirmed via telephone that no such account exists under my name. Despite this, the account remains on my credit profile and continues to damage my score. In XX/XX/XXXX XXXX, I submitted IRS Forms 1099-A and 1099-C on behalf of the estate and served both XXXX XXXX and XXXX & XXXX via certified mail with formal notice. To date, I have received no lawful validation, no correction of the record, and no cessation of this unlawful reporting. This violates multiple protections under both the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ) : Under the FCRA : 15 U.S.C. 1681s2 ( a ) : Furnishers must not report information they know or should know is inaccurate. 15 U.S.C. 1681i : Credit bureaus must reinvestigate disputed items within 30 days. No reinvestigation has occurred. 15 U.S.C. 1681e ( b ) : Credit bureaus must ensure maximum possible accuracy clearly not met here. Under the FDCPA : 15 U.S.C. 1692g ( b ) : Collection must stop until proper validation is provided. These actions are now preventing me from securing a vehicle, which I desperately need following a devastating semi-truck accident in XXXX that not only took my life for 8 minutes, I lost my vehicle, my tools & equipment, and means of survival. The impact of this situation is not theoretical it is immediate, personal, and destructive to my ability to fulfill my duties and provide for myself, my family, and my community. I am requesting : Immediate removal of the inaccurate account ( s ) Full investigation into all parties who failed to validate, respond, or act lawfully Accountability for any harm caused by these violations I have full documentation, certified mail receipts, and copies of all notices and IRS filings available upon request. This is not just about correcting a report its about defending the rights of fiduciaries, consumers, and people like me who refuse to be bullied by institutions that disregard the law.
