There is a student loan account reporting on my credit file that I did not open or apply for, or authorize anyone else to open or apply for using my personal information. This student loan originated from XXXX XXXX. I have disputed this fraudulent account several times ( the last time was on XX/XX/year> ) directly with the student loan company and with the credit bureaus and asked them to block the fraudulent account from being re-reported on my credit file since I am a victim of identity theft, however this account was reinstated by Transunion after being removed and despite my request for it to be blocked. I want to make it unequivocally clear that I did not apply for, authorize, co-sign, or in any way initiate a loan application with XXXX XXXX at any time. I have never applied for a student loan with XXXX XXXX, nor have I given consent for any individual to use my personal identifying information to apply for, endorse, or co-sign such a loan on my behalf. The appearance of this account on my credit report is the result of identity theft. I believe that my personal information may have been compromised due to my rental living situation. I rent rooms within my residence to temporary tenants, and despite taking reasonable precautions, this living arrangement has unfortunately made me vulnerable to the unauthorized use of my personal information. It is possible that someone with temporary access to my home used that access to obtain or misuse my personal identifying information without my knowledge or consent. Under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq., I am entitled to dispute inaccurate or fraudulent information in my credit report, and credit reporting agencies are required to investigate and correct such information promptly. Furthermore, under the Fair and Accurate Credit Transactions Act ( FACTA ), an amendment to the FCRA, victims of identity theft are entitled to place fraud alerts, request the removal of fraudulent accounts, and block the reporting of information that resulted from identity theft. Additionally, state consumer protection laws, including identity theft statutes ( depending on my state of residence ), further protect individuals in situations like mine and often provide for the removal of fraudulent information from consumer credit files and allow for restitution. This fraudulent information is preventing me from conducting very important personal business matters which require accurately reported credit files.
