Consumer Narrative
I am submitting this complaint against Credit Control LLC for knowingly and unlawfully reporting a debt that is not mine, despite clear evidence and multiple forms of identity verification proving otherwise. The alleged debt was originally owned by XXXX XXXX XXXX, who conducted an investigation and determined that the account was reported in error. It was connected to XXXX XXXX, not XXXX XXXX which is my legal name. As a result, XXXX removed the item from my credit reports with XXXX XXXX XXXX XXXXI have worked with all three credit bureaus to correct my profile and verify my identity. All three have confirmed the issue was resolved, and that I am not responsible for this debt. Yet Credit Control LLC, after acquiring the account from XXXX, re-reported the same invalid debt to the bureaus knowing full well that it was previously found to be inaccurate and removed. This is not only negligent it appears to be a willful and spiteful act, carried out despite having no legal basis to pursue the debt against me. To make matters worse, I formally requested validation of the debt, including : The original billing statement from the creditor, The original account letter, and Any identification or documents they used to conclude I was the responsible party. To date, they have failed or refused to provide any of this documentation. Their actions are in clear violation of several provisions of the Fair Credit Reporting Act ( FCRA ), including : 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) : Reporting information they know or should know is inaccurate ; 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( B ) : Failing to correct or update false information after discovery ; 15 U.S.C. 1681s-2 ( b ) : Failing to properly investigate a dispute after notification ; 15 U.S.C. 1681e ( b ) : Failing to use reasonable procedures to ensure accuracy.
