This serves as my final notice and formal complaint regarding XXXX XXXXXXXX XXXX ongoing violation of federal credit reporting and tax laws. XXXX has acknowledged in writing that my XXXX XXXX Rewards Credit Card ( account ending in XXXX ) was charged off on XX/XX/year>, and sold to XXXX XXXX XXXX on XX/XX/year>. Despite this, XXXX continues to report the account as a charge-off under their name to the credit bureaus misleadingly suggesting I still owe them a debt. This is a violation of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( a ) and ( b ), which requires furnishers to report accurate and complete information. Since XXXX no longer owns the debt and has been compensated through its sale, continued reporting under their name is inaccurate, misleading, and harmful to my credit profile. XXXX has also failed to issue a 1099-C for this charged-off debt, despite IRS regulations under 26 U.S.C. 6050P, which require that any discharge of indebtedness over {$600.00} be reported to the IRS and the consumer. Their failure to do so further violates federal law. I am requesting that the CFPB take enforcement action to require XXXX XXXXXXXX XXXX to : Cease reporting the charge-off under their name Update the tradeline to reflect a {$0.00} balance and sold/transferred status Issue a 1099-C, or provide a valid written explanation for why one is not required Confirm that all updates have been made with XXXX, Experian, and XXXX This is my final attempt to resolve this matter. If XXXX does not comply, I will pursue legal action under FCRA 1681n and 1681o for statutory damages, actual damages, punitive damages, and attorneys fees.
