Consumer Narrative

Dear Consumer Financial Protection Bureau, I am filing this formal complaint against XXXX XXXX XXXX XXXX XXXX and TransUnion for repeated violations of the Fair Credit Reporting Act ( FCRA ), Fair Debt Collection Practices Act ( FDCPA ), XXXX XXXX XXXX, and IRS reporting obligations. Complaint Summary : An account originally held by XXXX XXXX XXXX XXXX was allegedly transferred to XXXX XXXX XXXX, who is now attempting to collect a debt that is currently marked as closed on my credit report. My prior dispute submitted to TransUnion was denied without providing me a legal method of verification or the documentation required by law. Key Issues : 1. Unverified and Improper Debt Collection : TransUnion marked this dispute resolved on XX/XX/XXXX, without conducting a proper reinvestigation ( Dispute ID : XXXX ). I never received a 1099-C cancellation of debt form, which is required by law for any cancelled or charged-off debts over {$600.00}. No original signed documentation has been presented to prove I authorized XXXX XXXX XXXX to collect on this account. 2. Contradictory Reporting : Although the account appears as closed, XXXX sent me a notice dated XX/XX/XXXX, offering to settle for {$650.00} or through payment plans. This contradiction shows ongoing collection activity on what is reported as a closed tradeline, a deceptive and misleading practice. 3. Violations of Federal and XXXX Law : 15 U.S. Code 1692c ( c ) : Continued contact without proper debt validation. 15 U.S. Code 1692e ( b ) : Inaccurate and misleading credit reporting. 15 U.S. Code 1681i ( a ) : TransUnion failed to reinvestigate properly. 15 U.S. Code 6802 : Unauthorized handling of my financial information. XXXX XXXX XXXX XXXX & XXXX : Failure to correct false credit information and use of deceptive means to collect. 4. Method of Verification Ignored : I requested full method of verification, including : Who verified the debt, and what documentation was used. Whether I ever gave legal consent for XXXX to collect this debt. What legal authority XXXX has to collect debt in XXXX. Requested Action : I respectfully request that the CFPB : Investigate the false, inaccurate, and unverified reporting by XXXX and TransUnion. Order TransUnion to remove the disputed tradeline unless verified with signed, original documentation. Enforce compliance with the IRS, FCRA, FDCPA, and XXXX XXXX XXXX. Require TransUnion to disclose exactly what verification process was used to validate the dispute. Attached you will find supporting documentation from XXXX XXXX and a copy of the collection letter from XXXX, which clearly contradicts the reported status of the account. I am asserting my legal rights under federal and state consumer protection laws and request your urgent attention in this matter. Sincerely, XXXX XXXX XXXX
