I previously submitted a complaint ( XXXX ) which was closed out. Dear CFPB Representative, I am submitting this follow-up complaint regarding multiple inaccurate accounts listed on my credit report from Equifax. These accounts are being reported as charge-offs without the corresponding issuance of IRS Form 1099-C, which raises serious legal and accuracy concerns under both federal tax law and the Fair Credit Reporting Act ( FCRA ). 1. Charge-Offs with No 1099-C Issued Potential Tax Law Violation Under 26 U.S. Code 6050P, any applicable financial entity ( including banks and credit card companies ) that discharges {$600.00} or more in indebtedness must file IRS Form 1099-C and furnish the same to the debtor. The presence of a charge-off on my credit report indicates the creditor considered the debt uncollectible, which would typically trigger a taxable cancellation of debt. This appears to be a blatant attempt to re-age the debt in violation of the FCRA and FDCPA, which prohibit re-aging to extend reporting timelines ( 15 U.S.C. 1681c ). 3. Accounts Being Disputed ( Still Reporting ) Below is a list of the remaining accounts that continue to report charge-off or paid/closed status without valid 1099-C documentation, and which I formally dispute again : Equifax : XXXX XXXX Account ending in XXXX {$790.00} XXXX XXXX Account ending in XXXX {$920.00} XXXX XXXX Account ending in XXXX {$110.00} 4. Requested Relief I respectfully demand the following : 1. Deletion of any charge-off accounts where the creditor has not issued a 1099-C and has confirmed the debt remains outstanding, as this is inherently inaccurate and misleading credit reporting. 2. A formal investigation into all listed accounts for failure to comply with : 26 U.S.C. 6050P ( 1099-C requirements ) 15 U.S.C. 1681e ( b ) and 1681i ( FCRA accurate and complete reporting ) 15 U.S.C. 1681c ( a ) ( 4 ) ( Re-aging prohibition reporting period starts from date of first delinquency ) 3. Documentation from the furnishers showing : Whether a 1099-C was issued, and Whether the account was legally forgiven, settled, sold, or remains collectible. If the creditors can not provide documentation of debt forgiveness or a valid legal basis for the charge-off label, I demand these items be deleted from my credit report under the FCRA.
