However, they failed to : Permanently delete the account as demanded ; Provide proof of validation or original contractual evidence ; Address the legal basis I cited under FCRA, IRS cancellation treatment, and UCC protections ; Acknowledge that a previously charged-off and canceled account from XXXX XXXX was deleted under identical circumstances, as evidenced by the attached Form 1099-C. Secured Party Status & UCC Protection I am the Secured Party to the debtor entity known as XXXX XXXX. My UCC-1 Financing Statement is perfected and filed with the New York Department of State in XXXX. As XXXX XXXX, I retain legal and equitable control over all financial data, estate, and property attached to the legal fiction used in commerce. Equifax has no lawful authority to continue reporting, sharing, or monetizing data about the debtor without my express written consent. Supporting Evidence : Form 1099-C from XXXXXXXX XXXX ( attached ) shows a charge-off was acknowledged and removed from my report by Equifax previously. This sets precedent that Equifax can and must delete accounts that are canceled, XXXX, or no longer legally enforceable. The XXXX XXXX account has not been validated, remains disputed, and violates multiple federal provisions.
