I am disputing a fraudulent collection account placed on my XXXX report by Kimball , Tirey & St. John LLP. They are reporting that they are the original creditor and are attempting to collect over {$26000.00}, despite there being no legal judgment ordering me to pay this amount to them or to XXXX XXXX XXXX. The case in question was an unlawful detainer ( eviction ) case, not a debt collection case. There was no monetary judgment issued by the court. I was not properly served, and the process server never obtained substitute service approval. The result was a default judgment for possession only. Additionally, Kimball , Tirey & St. John LLP was not the original law firm on the case. The court records clearly show that XXXX, XXXX, XXXX XXXX XXXX XXXX was the original attorney for XXXX XXXX. XXXX XXXX did not appear on the case until after a substitution of attorney was filed on XXXX well after the judgment had been entered. Therefore, they were never a party to any legal action against me while the case was active. They assumed a role after the court process had ended and are now falsely reporting themselves as both the creditor and enforcer of a judgment that does not exist.
