I originally took out the loan with XXXX on XX/XX/XXXX I was notified the loan originally went into default in XX/XX/XXXX. I was offered a payment plan back in XX/XX/XXXX. I made some payments but was in financial distress situation as a single mother of a toddler. Of which I did fully communicate this to XXXX back then. XXXX XXXX XXXX hasnt provided the original promissory note or the original default agreement. I have already asked them to completely remove this negative mark from my credit and their response was a hard no. According to the statute of limitations in the state of Georgia, a loan default is between four ( 4 ) to six ( 6 ) years. Its been well beyond nine ( 9 ) years since the original default on the loan. As of XX/XX/XXXX, XXXX ( XXXX ) years have passed from the original default date. They have continued to harass me with phone calls and text messages beyond the statute of limitations on this loan default. Now they hired this company to sue me, threaten me with a judgement, and they also lied saying that I was served.
