I am submitting this formal complaint due to willful and negligent violations of the Fair Credit Reporting Act ( FCRA ), the Fair Debt Collection Practices Act ( FDCPA ), and IRS Code 6050P by one or more credit reporting agencies ( Experian, Equifax, TransUnion ) and their associated data furnishers. I am a documented victim of identity theft, supported by FTC Identity Theft Report # XXXX ( attached ). Despite submitting the proper documentation and disputes to the credit bureaus, fraudulent accounts and inaccurate public records remain on my credit report, which has caused irreparable financial harm, stress, and reputational damage. ISSUES I AM REPORTING INCLUDE : Failure to Remove Fraudulent Accounts and Inquiries Numerous accounts were fraudulently opened in my name, including credit cards, auto loans, and installment accounts. Despite notice and documentation, the credit bureaus have failed to permanently remove these items in violation of : FCRA 1681c-2 Duty to block identity theft-related information within 4 business days FCRA 1681e ( b ) Obligation to report only accurate data FCRA 1681i ( a ) Duty to reinvestigate disputed items within 30 days Illegally Reported XXXX XXXX Bankruptcy ( Ref : XXXX ) A bankruptcy was falsely reported under my identity. I did not file for bankruptcy and have provided proof of fraud. This is a major violation of the FCRA and a clear failure to ensure maximum possible accuracy. Continued Reporting of Charged-Off and Cancelled Debt Certain creditors and debt buyers ( e.g., XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX have reported charged-off balances and/or filed Form 1099-C to the IRS, indicating debt cancellation. Under : IRS 26 U.S.C. 6050P FCRA 1681e ( b ) and 1681s-2 ( b ) FDCPA 1692e ( 2 ) ( A ) These debts must no longer be reported as active or with balances. Doing so misrepresents the status of the debt and violates federal law. Inaccurate Reporting of Employment and Address Information Several employers and addresses that do not belong to me are being reported and have not been removed, even after multiple disputes.
