Consumer Narrative

Subject : Formal Complaint Against Credit Reporting, Debt Collection, and Garnishment Violations ( FCRA & FDCPA ) To Whom It May Concern, I am filing a formal complaint regarding inaccurate credit reporting, unlawful debt collection practices, and an improper garnishment related to a charged-off account. This issue involves violations of the Fair Credit Reporting Act ( FCRA ), the Fair Debt Collection Practices Act ( FDCPA ), and potential violations of my rights concerning wage and bank account garnishment. Issue # XXXX : Credit Report Inaccuracy ( FCRA Violation ) The following account on my XXXX credit report contains discrepancies that must be investigated. If the debt is charged off/ written off, meaning the creditor already took a loss. It should not still be actively pursued in the form of a lawsuit and garnishment. The inconsistency violates my rights under 15 U.S.C. & 1681s-2 ( a ) of the FCRA. Creditor Name : Discover Bank Account Number : XXXX Reported Balance : {$2400.00} ( Charged-Off ) Status : Account charged off/written off but still being pursued for collection at a different balance. The problem : My credit report states that this account is charged off/written off, yet I am still being pursued for collection at a different amount. Since the debt is charged off, it should not reflect an active balance subject to collection or legal action. This reporting is inaccurate and misleading, damaging my credit profile. Issue # XXXX : Debt Collection Violation ( FDCPA Violation ) I am also being pursued for garnishment on this same debt, but the debt collector has failed to properly validate the debt, as required under the FDCPA. My concerns include : XXXX. The creditor has already charged off/written off the debt, yet they are still attempting to collect through legal action. XXXX. The amount they claim I owe does not match my credit report. XXXX. I have not received including proof of the original agreement, payment breakdown, or ownership transfer. Issue # 3 : Improper Garnishment I recently received a garnishment notice stating that my bank account will be frozen and/or my wages are being garnished. This garnishment appears to be unlawful due to the following reasons : The creditor failed to properly notify me before initiating garnishment actions. The amount being garnished does not match the reported balance on my credit report. According to the notice I received, I have 14 days to dispute the garnishment. I am formally requesting an exemption of protected funds and a review of the garnishments legality. Requested Action from the CFPB : I am requesting that the CFPB immediately investigate and take action against the responsible parties. Specifically, I request : XXXX. That the credit reporting agencies correct/remove any inaccurate, misleading, or unverifiable information regarding this charge-off. XXXX. That the debt collector be required to validate the debt properly before any further collection or legal action. XXXX. That my garnishment be reviewed for violations of federal and state laws, and, if necessary, be stopped or reversed. XXXX. That enforcement action be taken if my consumer rights under the FCRA, FDCPA, or garnishment laws have been violated. I appreciate the CFPBs attention to this matter and request a prompt investigation. Please keep me informed of any updates regarding this complaint. Sincerely, XXXX XXXX
