Consumer Narrative
This letter serves as a formal dispute and final demand for removal of the following inaccurately and unlawfully reported tradeline by XXXX XXXX : Creditor Name : XXXX XXXX Account Number ( Last XXXX ) : XXXX Account Type : Auto Loan Opened : XX/XX/XXXX Charged Off Balance : {$3500.00} Last Payment : XX/XX/XXXX Status Last Updated : XX/XX/XXXX Reporting Since : XXXX ( XXXX negative months as of XXXX ) I have repeatedly disputed this account, and Ally Financial has consistently failed to provide any verification or resolution. Their continued reporting is in direct violation of multiple provisions of the Fair Credit Reporting Act ( FCRA ). Despite my efforts, this account has remained unchanged showing a complete disregard for their obligations as a data furnisher and your legal responsibilities as a credit reporting agency. GROUNDS FOR DISPUTE XXXX. Re-aging of Debt Illegal Extension of Reporting Period The account originated in XXXX, and charge-off activity is still being reported as of XXXX almost XXXX years later. This is a clear violation of : FCRA 1681c ( a ) ( 4 ) : Negative information like charge-offs may not be reported more than XXXX years from the Date of First Delinquency ( DOFD ). FCRA 623 ( a ) ( 5 ) : Requires furnishers to report the accurate DOFD. Ally appears to have re-aged this account by using status update dates ( like XX/XX/XXXX ) instead of honoring the true delinquency timeline. This is not just misleading its unlawful. XXXX. Incomplete & Inconsistent Reporting The payment history includes : Months marked ND ( No Data ), which hides derogatory or relevant status changes. R ( Repossession ) codes in XXXX and XX/XX/XXXX. Continued CO ( Charge-Off ) reporting well after repossession. There is no record of vehicle disposition or any indication that the balance reflects a lawful adjustment following repossession and resale which is standard under consumer finance law. This violates FCRA 1681i ( a ) credit information must be complete and not misleading. Allys reporting is incomplete, inaccurate, and potentially deceptive. XXXX. Unverified or Inflated Balance Post-Repossession The original loan was for {$19000.00}, and now shows a charged-off balance of {$3500.00}. However : There is no documentation showing that XXXX applied any proceeds from the vehicles sale to this balance. The consumer has received no breakdown of fees, interest, or deductions. If XXXX failed to apply the vehicles sale proceeds, then the amount they are reporting is inflated and illegal. This constitutes a violation of FCRA 1681s-2 ( a ) ( 1 ) ( A ) which mandates that furnishers only report information that is accurate and reflective of actual liability. XXXX. Repeated Disputes Ignored No Verification Provided I have previously contacted Ally Financial to dispute this account and request verification. They have : Ignored all requests for documentation. Provided no validation of the balance, repossession outcome, or XXXX. Failed to issue any updates or corrections. This is a violation of : FCRA 611 ( 15 U.S.C. 1681i ) : Credit bureaus must investigate disputes and delete unverifiable information. FCRA 1681s-2 ( b ) : Furnishers must respond to disputes forwarded by bureaus. XXXX. Failure to Mark the Account as Disputed If this account is being reported as verified without any notation of dispute, that is a separate violation under : FCRA 623 ( a ) ( 3 ) : Furnishers must flag disputed accounts. FDCPA 1692e ( 8 ) : It is deceptive to report a disputed debt as undisputed. DEMAND FOR IMMEDIATE ACTION Pursuant to FCRA 611, I am requesting : A full reinvestigation of this account. Written proof of the DOFD, charge-off calculation, repossession sale, and legal liability. Immediate deletion of the XXXX XXXX account if verification can not be provided within XXXX days. If this account remains without proper validation or correction, I will be forced to escalate this matter by filing formal complaints with : The Consumer Financial Protection Bureau ( CFPB ) The Federal Trade Commission ( FTC ) My State Attorney Generals Office I am fully aware of my rights under federal law and will pursue all remedies available, including legal action, if this matter is not resolved in full compliance with the FCRA.
