Consumer Narrative
I am filing this complaint against XXXX and Blitt & Gaines, P.C. for engaging in coordinated fraudulent behavior, concealment of third-party involvement, and ongoing violations of federal law during a disputed debt collection case. XXXX is not a named party in the court case, but XXXX XXXX XXXXXXXX Fraud Department confirmed on a recorded call that XXXX XXXX in control of the account, including initiating all fraud claims and balance reversions. Despite this, Blitt & Gaines has never disclosed XXXX involvement in their CFPB responses or court filings. Blitt & Gaines submitted Exhibit C in courta fraudulent claim evaluation document that was generated by XXXX. They falsely claimed I initiated that fraud claim. However, I have never contacted XXXX directly, and multiple police reports, sworn statements, and transcripts show that I did not authorize or initiate the claims they are attributing to me. This is critical because the alleged balance on the account was fraudulently reinstated using claim evaluations that BoA later confirmed were handled by XXXX. That reinstatement forms the foundation of the lawsuit Blitt & Gaines is pursuing. Despite this, Blitt & Gaines has : Never submitted a sworn affidavit to dispute the identity theft. Attempted to strike Illinois Rule 280.5, which requires such a response. Filed motions to strike all of my pleadings, in an effort to silence me as a pro se defendant. I previously filed CFPB complaints against XXXX XXXX XXXX and Blitt & Gaines, and against XXXX XXXX XXXXXXXX and XXXX. Now, I am filing this one because Blitt & Gaines and XXXX are clearly acting in concert to misrepresent the ownership, legal status, and fraud history of the account. These parties have used fraudulent documents, suppressed critical evidence, and withheld material information from both the court and federal regulators. This is not a billing disputeit is a case involving : Fabricated claim evaluations. Fraudulent reinstatement of debt balances. False court filings. Suppression of third-party vendor involvement. Violation of the Fair Debt Collection Practices Act ( 15 U.S.C. 1692e, 1692f ) and the Fair Credit Reporting Act ( 15 U.S.C. 1681s-2 ( b ) ) I request full investigation into the actions of XXXX and Blitt & Gaines , and demand accountability for the fraudulent, coordinated, and deceptive behavior they have exhibited throughout this litigation and regulatory process. This complaint follows two previously filed CFPB complaints : one against XXXX XXXX XXXXXXXX and XXXX, and one against XXXX XXXX XXXX and Blitt & Gaines.
