Consumer Financial Protection Bureau Complaint From : XXXX XXXX XXXX Date : XX/XX/year>, regarding : Complaint against Commenity Bank to Whom It May Concern : I, XXXX XXXX, am filing this complaint against Commenity Bank a debt collection agency. I am being contacted by Commenity Bank regarding a debt they claim I owe, despite the fact that they are not the original creditor of this debt. They have failed to properly validate this debt upon my request and have continued collection attempts without providing sufficient proof that they legally own the debt or have the right to collect on it. Specifically, Commenity Bank has not provided proper verification of the debt including the name of the original creditor, the original agreement, and documentation showing the complete chain of ownership from the original creditor to Commenity Bank. They have continued collection efforts despite my written dispute of the debt and have not provided proper validation within the XXXX timeframe required by the Fair Debt Collection Practices Act ( FDCPA ). I believe XXXX XXXX has violated several provisions of the FDCPA, including failure to properly validate the debt upon request, attempting to collect a debt without proper legal standing, continuing collection activities during the dispute period, and engaging in harassing and intimidating collection practices. Their communications have been intimidating and have caused me significant stress and anxiety. Under the FDCPA ( 15 U.S.C. 1692 et seq. ), third-party debt collectors like Commenity Bank must provide validation of a debt within XXXX days of initial contact, cease collection activities until proper validation is provided, provide complete information about the original creditor, and demonstrate legal standing to collect the debt. Furthermore, debt buyers who purchase debt from original creditors must maintain and provide complete documentation showing their legal right to collect, including the complete chain of ownership.
