As a consumer, I have rights that must be upheld, and it is my expectation that XXXX, XXXX and XXXX, as consumer reporting agencies, fulfill their legal responsibilities fairly, impartially, and with respect for my privacyas required under the Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1681 Section 602 ( a ). Federal law makes it clear that financial institutions and credit reporting agencies have an ongoing duty to protect the privacy, security, and confidentiality of my nonpublic personal information ( 15 U.S.C. 6801 ). However, despite this legal obligation, my information has been shared and reported without my explicit consent. Under 15 U.S.C. 1681 Section 604 ( a ) ( 2 ), consumer reporting agencies can only furnish a credit report if the consumer has provided written instructions authorizing them to do sowhich I have not. Let me be clear : I do not consent to XXXX, XXXX, XXXX, or any furnisher of information to credit agencies to share or report my personal financial data in any formverbal, non-verbal, written, implied, or otherwise. I am revoking any perceived or assumed consent, effective immediately. Additionally, under 15 U.S.C. 6802 ( b ) ( c ), financial institutions are prohibited from disclosing my nonpublic personal information to third parties unless I have been given an option to opt-outan option I was never informed of. This is a clear violation of my privacy rights. Furthermore, 15 U.S.C. 1681c ( a ) ( 5 ) prohibits credit reporting agencies from including adverse information older than seven years on a consumer reportyet, certain accounts that qualify as negative or adverse remain on my credit file, unlawfully impacting my credit standing. Under 15 U.S.C. 1681s-2 ( A ) ( 1 ) ( A ), no furnisher of credit information should report data if they know, or have reasonable cause to believe, that the information is inaccurate. By allowing inaccurate, outdated, and unauthorized information to remain on my report, XXXX, XXXX and XXXX are in direct violation of federal law. Additionally, under 15 U.S.C. 1681e, consumer reporting agencies are required to maintain reasonable procedures to ensure the maximum possible accuracy of credit reportsa duty that has not been fulfilled in my case. Finally, 12 CFR 1016.7 grants me the right to opt out of having my information shared, and I am formally exercising that right now. I am demanding that XXXX, XXXX and XXXX immediately remove all unauthorized, inaccurate, and outdated information from my credit report. Failure to do so will result in formal complaints being filed with the appropriate regulatory agencies, including the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and the U.S. Department of Justice.
