Consumer Narrative
In XX/XX/XXXX, my XXXX XXXX XXXX XXXX was deemed a total loss by my insurance company, XXXX. The XXXX was in a not-at-fault accident on XX/XX/XXXX, and the collision center did not have availability to give an estimate of damages until XX/XX/XXXX. The collision center kept the van for three months and ordered parts to start repairs. XXXX XXXX stopped the collision center before they began repairs and asked them to total the XXXX. I was never informed of the total loss until I called to get an update on my vehicle. After I got the update from the collision center, I called XXXX and began the process to ensure they would cover the cost of my XXXX, as I had a million-dollar collision policy with XXXX and gap coverage through XXXX XXXX XXXX When I called XXXX XXXX to get my gap insurance information to file a claim for the {$4700.00} balance not covered by my insurance with XXXX, the finance manager, told me I did not have gap coverage. I called XXXX XXXX financial again 5 times and spoke with different representatives who all confirmed I did not have gap coverage, which I initially signed up for during the purchase of my XXXX XXXX and paid for through my loan with XXXX XXXX. In XXXX I called XXXX XXXX to inquire about my warranty refund, and the representative asked if I wanted a refund for my gap insurance too. I asked if I could use the gap insurance to cover the balance of the vehicle, and I was told it expired. I asked why I was not allowed to use the gap coverage at the time of my initial accident claim and was told she did not know, but the representative told me that I did have gap coverage at the time of my accident in XXXX, but since I did not use the gap coverage, I would receive a refund of {$300.00}. Because of this negative loan balance, I can not get a new loan for another vehicle. In this case, XXXX XXXX XXXX committed insurance fraud.
