I am filing this complaint against Experian for their continued violations of the Fair Credit Reporting Act ( FCRA ), failure to follow reasonable procedures, and refusal to properly address my dispute. Despite my previous attempt to resolve this matter privately, Experian has failed to take corrective action, leaving me no choice but to escalate this issue to the Consumer Financial Protection Bureau ( CFPB ). Additionally, Experians actions demonstrate willful and negligent noncompliance with the FCRA under 15 U.S.C. 1681n and 15 U.S.C. 1681o. Instead of properly investigating my dispute, Experian has failed to follow reasonable procedures to assure maximum possible accuracy as required by 15 U.S.C. 1681e ( b ). Furthermore, I demand that no AI verification through the E-OSCAR system be used in handling this dispute, as it does not constitute a reasonable investigation. As a direct result of Experians reckless reporting and failure to correct this inaccurate information, I have suffered severe financial and emotional distress. I am unable to secure a mortgage for my family due to this erroneous entry, leaving us in an unstable housing situation. This constitutes actual damages, and under 15 U.S.C. 1681n, Experian is liable for statutory damages of up to {$1000.00} per violation, in addition to punitive damages for willful misconduct. I am formally demanding that Experian immediately delete the XXXX XXXX account from my credit report and provide me with written confirmation and an updated copy of my corrected report within 14 days. If Experian fails to comply, I will have no choice but to seek legal counsel and pursue full monetary damages under the FCRA, including for defamation of character and emotional distress. I urge the CFPB to take immediate action to enforce XXXX compliance with federal consumer protection laws and hold them accountable for these violations.
