I am writing to file a formal complaint against National Credit Adjusters ( NCA ) for reporting inaccurate and unverifiable information as a collection account on my credit report and for failing to provide required verification of the debt. In XX/XX/year>, I made a formal request to NCA for verification of the alleged debt, including detailed documentation and mailing information, as required under the Fair Debt Collection Practices Act ( FDCPA ). Despite my request, NCA has failed to send any documentation to verify the debt, in violation of 15 U.S.C. 1692g, which mandates that debt collectors provide verification upon request. Furthermore, NCA has reported the debt on my credit report, which I assert is inaccurate and unverifiable. This violates the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S.C. 1681s-2 ( b ), which requires that furnishers of in formation to credit reporting agencies must investigate disputes and correct any inaccurate information. That NCA cease and desist all future communications with me regarding this matter, in accordance with 15 U.S.C. 1692c ( c ), which allows consumers to request that debt collectors stop contacting them. Additionally, I would like to inform NCA that their failure to remove the inaccurate and unverifiable collection account will result in my pursuit of legal action for statutory damages under 15 U.S.C. 1692k ( FDCPA ) and 15 U.S.C. 1681n ( FCRA ) for willful noncompliance. I will also consider pursuing claims for damages resulting from their noncompliance with the Consumer Credit Protection Act ( CCPA ) and any other applicable laws. I trust that the CFPB will investigate this matter thoroughly and ensure that NCA is held accountable for their violations.
