Consumer Narrative
I am submitting this formal complaint against XXXX and Upstart for violations of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681, and the Bankruptcy Code, 11 U.S.C. 524. XXXX has engaged in fraudulent reporting practices by initiating a dispute on my behalf that I did not authorize. Additionally, Upstart has unlawfully reopened an account that was included in my XXXX XXXX bankruptcy ( filed in XX/XX/year> ) and has reported a late fee of {$75.00}, which is both inaccurate and a violation of federal bankruptcy laws. XXXX 's Fraudulent Dispute Process XXXX acted fraudulently when it initiated a dispute with Upstart regarding my account without my consent. This is a direct violation of 15 U.S.C. 1681i ( a ) ( 1 ) ( A ), which mandates that consumer reporting agencies investigate disputes that are submitted by the consumer. In this case, XXXX falsely represented my dispute status, effectively fabricating a dispute that I never authorized. This deceptive practice is misleading and potentially actionable under 15 U.S.C. 1681s-2 ( b ), which holds credit bureaus accountable for the accuracy of consumer credit information. Upstart 's Illegal Account Relisting & False Reporting Upstart, a creditor listed in my XXXX XXXX bankruptcy, closed the account upon my filing, as required by 11 U.S.C. 524 ( a ) ( 2 ), which permanently bars creditors from attempting to collect on a discharged debt. Despite this, Upstart relisted the account on my credit report and added a {$75.00} late fee, which constitutes an unlawful attempt to collect a discharged debt. This action is a clear violation of the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692e, which prohibits false or misleading representations regarding a debt. According to the Fair Credit Reporting Act ( FCRA ) n Section 605B, It is illegal to report information on my credit report without my permission, please remove all disputed items from my credit report.
