Dear Credit Bureau, I recently noticed that there recorded on my credit report that there were late payments on the following XXXX XXXX account numbers : XXXX XXXX number XXXX XXXX XXXX XXXX XXXX. Your company is in clear violation of the law. Under 15 USC 1681B permissible purpose of a consumer report the law clearly states in general subject to subsection C. Any consumer reporting agency may furnish a consumer report under the following circumstances and no other. ( No. 2 ) In accordance with the written instruction of the consumer to whom it relates. Did I give written instructions for this to be on my credit report? No, I didnt give permission for this to be on my credit report. Furthermore the Fair Credit Reporting Act 15 USC 1681 ( 2 ) ( a ) ( 1 ). Exclusions from a consumer report clearly states : ( 2 ) Exclusions : Except as provided in paragraph ( 3 ), the term consumer report does not include : Subject to section 1681 ( S ) 3 of this title any : - Report containing information solely as to transactions or experiences between the consumer and the person making the report. Delete this late payment and these accounts from my credit report immediately. This agency is in clear violation of 15 USC 1681. Failure to respond gives me the legal right to take legal action against your company as you are in clear violation of the law. And the law clearly states that under civil liability based on 15 USC 1681N that I can and will seek a {$1000.00} per violation if the matter is addressed based on my requests. If you fail to delete the late payments and update the account to pay as agreed and delete these accounts from my credit report then I will be forced to file a lawsuit against your company and seek a {$1000.00} compensation for each violation. The violations that I will seek compensation for or as follows : - Defamation of character ( Pr Se ) Negligent enablement of identity fraud Fair Debt Collections Practice Act Fair Credit Reporting Act -violation for willful non -compliance. It is my hope that we can resolve this matter amicably and that I won't have to take the matter to court so as to get you to abide by federal consumer laws.
