In an attempt to dispute credit report status, Experian disputed one creditor who was filed in my bankruptcy and listed the account as zero balance and closed. Experian sent them a dispute from me WHICH I DID NOT SEND! This is fraudulent directly from Experian. When I called the representative ( XXXX ) informed me that the dispute that I sent along with the proof from the creditors that was sent to me informing me that I do not owe them was said to not have been seen because their upload at Experian is not working. She also inform me that Experian send the dispute. I informed her that when Experian sends the dispute to the creditor, the creditor sends me a letter that says I am not obligated to pay. Then I dispute with Experian again to remove the account or report the account amount as XXXX and they send it back to the creditor and it's been a vicious cycle. The creditor XXXX has relisted the account and charged a {$75.00} late fee on my credit report. The creditor Upstart has never inquired about the account and had chosen to close the account when I filed bankruptcy Chapter XXXX in XXXX XXXX have never received a letter from Upstart and I the only reason I found out was because I looked at my credit report. This is illegal! Also, The account has been reactivated on XXXX as well. I sent a letter to Experian that states : XXXX XXXX XXXX XXXX Community XXXX XXXX, AR. XXXX XXXX XXXX XXXX XX/XX/XXXX Experian Dispute XXXX Department XXXX XXXX XXXX XXXX XXXX TX XXXX Subject : Formal Dispute of Inaccurate Credit Reporting Under FCRA To Whom It May Concern, I am writing to formally dispute inaccurate and misleading information on my credit report under the Fair Credit Reporting Act ( FCRA ) ( 15 U.S.C. 1681 ). The following accounts are being reported incorrectly and must be removed or corrected immediately. I believe that Experian is using a tactic called " debt parking '' ( also known as passive debt reporting ), where original creditors or debt collectors place derogatory marks on my credit report without actively attempting to collect the debt. These accounts are being reported incorrectly under multiple statuses ( e.g., " charge-off, '' " closed, '' " amount owed, '' and " bankruptcy '' ) simultaneously, which violates FCRA 's XXXX requirements. XXXX. There is no debt XXXX listed on my report, yet the debts appear as if they are still owned by the original creditor, which is misleading and a possible case of debt parking under the FCRA and FDCPA. Requested Action : Remove or correct the inaccurate reporting on my credit file immediately. Provide me with written confirmation of the corrections made. Provide me with the method and source of verification for these debts. Legal Notice : As per the FCRA ( 15 U.S.C. 1681i ), you are required to investigate and correct these errors within 30 days. If these inaccuracies are not corrected, I will escalate this matter by filing complaints with the following agencies : Consumer Financial Protection Bureau ( CFPB ) Federal Trade Commission ( FTC ) My state attorney general 's office I will also consider legal action for damages under FCRA violations.
