Consumer Narrative
Dispute Letter to XXXX Regarding Returned Payments & Lack of Notification XXXX XXXX XXXX ( XXXX ) XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX [ Your Phone Number ] [ Your Email ] [ Date ] XXXX XXXX XXXX Department XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Subject : Formal Dispute of Returned Payments & Lack of Notification Account Ending in XXXX Dear XXXX Dispute Resolution Department, I am writing to formally dispute the handling of two payments I submitted toward my XXXX XXXX account ( ending in XXXX ) on XX/XX/XXXX and XXXX. Both payments of {$50.00} each were returned unpaid, yet XXXX failed to provide proper notification to allow me the opportunity to rectify the issue. This lack of communication is a violation of my rights under federal consumer protection laws. Legal Basis for Dispute 1. Fair Credit Billing Act ( FCBA ) 15 U.S.C. 1666 The FCBA requires creditors to notify consumers of any billing errors, including failed or rejected payments. Since XXXX failed to notify me in a timely manner, this denial of proper notice prevented me from correcting the issue. 2. Electronic Fund Transfer Act ( EFTA ) 15 U.S.C. 1693 If a payment was attempted via electronic transfer ( ACH or debit ), Regulation E mandates that financial institutions and creditors provide notice of any rejected or failed transactions. Failure to do so violates consumer rights under this law. 3. Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1681s-2 ( a ) XXXX reported my account negatively due to the returned payments, this reporting is potentially inaccurate and unfair, as I was never given the chance to rectify the situation before it escalated. The payments were made via the mobile app. I quick selected a bank account that I had closed. If I would had been noticed I would had rectify the billing error immediately. Just like I did today ( XX/XX/XXXX ) after speaking to customer service, the representative could not tell me which payment was being reported late until he further investigated and informed me that the payments were returned unpaid. The payment history reflects one of the payments of {$50.00} dated XX/XX/XXXX as paid. This is very misleading as is reflecting that the payment was made instead of reporting the status as declined, returned. Etc. In XX/XX/XXXX I had a similar situation and that payment reflected as declined. I was able to make that payment before it affected my credit.
