( SEE ATTACHMENT ) Under IRS regulations ( 26 U.S.C. 6050P ), a creditor who files a 1099-C for cancellation of debt has reported to the IRS that they have forgiven the debt, which is considered settled for tax purposes. Continuing collection efforts on a canceled debt may be a violation of the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692e ( 2 ) ( A ), which prohibits misrepresenting the legal status of a debt and I may take further action, including filing complaints with the Consumer Financial Protection Bureau ( CFPB ), the Federal Trade Commission ( FTC ), and my states Attorney General. Once a creditor files IRS Form 1099-C ( Cancellation of Debt ), the debtor is generally no longer liable for repaying the canceled debt to the creditor.
