XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX Date of Birth : XX/XX/year> Phone Number : [ Insert Your Phone Number ] [ Date ] Consumer Financial Protection Bureau ( CFPB ) XXXX XXXX XXXX XXXX XXXX XXXX Re : Formal Dispute of Fraudulent, Inaccurate, and Incorrect Information on My Credit Reports FTC Identity Theft Report Number : XXXX Dear Sir/Madam, I am writing to file a formal complaint against the XXXX major credit bureausExperian, Equifax, and TransUnionfor failing to remove fraudulent, inaccurate, and incorrect information from my credit reports that I believe is harming my financial well-being, despite my repeated attempts to resolve this matter. I am aware of my rights under the FCRA and request that all fraudulent and inaccurate information be removed from my credit files immediately. This is my third attempt to correct the issues with the credit reporting agencies, but they have not acted in accordance with the Fair Credit Reporting Act ( FCRA ) and other applicable consumer protection laws. I previously filed an FTC Identity Theft Report ( # XXXX ), which outlines the fraudulent and incorrect information that has been reported on my credit files. Despite my submission of this report and direct communication with each of the credit bureaus, the disputed items remain on my credit reports. As required by law, the credit bureaus have an obligation to investigate and correct any inaccuracies, but they have failed to do so. Recently the CFPB filed lawsuits against Experian and Equifax for failure to properly investigate consumer disputes, citing sham investigations and other unlawful practices. By reinserting previously disputed and inaccurate information without explanation. I am formally requesting that the CFPB intervene in this matter due to the credit bureaus ' noncompliance with the legal standards established under U.S. law. Relevant U.S. Laws and Codes Protecting Consumers : 1. Fair Credit Reporting Act ( FCRA ) - 15 U.S.C. 1681 The FCRA mandates that credit reporting agencies ensure the accuracy and completeness of the information in consumer credit reports. Under Section 1681i ( a ), the credit bureaus must correct or delete any inaccurate, incomplete, or unverifiable information within 30 days of receiving a dispute. The failure to remove the fraudulent and inaccurate information from my credit reports is a violation of this law. 2. Identity Theft and Assumption Deterrence Act - 18 U.S.C. 1028 This act provides protection against identity theft and mandates that consumer information be handled carefully. The continuing reporting of inaccurate information related to identity theft is a violation of this act. 3. Fair Credit Billing Act ( FCBA ) - 15 U.S.C. 1666 The FCBA provides protections for consumers in billing disputes, including the right to dispute charges and errors. In the context of identity theft, the FCBA gives me the right to dispute fraudulent accounts or charges and demand their removal from my credit file. 4. Gramm-Leach-Bliley Act ( GLBA ) - 15 U.S.C. 6801-6809 The GLBA mandates that financial institutions protect consumers personal financial information, including ensuring the accuracy and security of credit report data. 5. Fair Debt Collection Practices Act ( FDCPA ) - 15 U.S.C. 1692 The FDCPA offers protections against debt collectors who report inaccurate or fraudulent debts. As part of my rights under this act, I am entitled to dispute inaccurate debts, and they must be removed from my credit report if found to be fraudulent or erroneous that has harmed my financial well-being. Complaint Summary : Fraudulent and inaccurate information continues to appear on my credit report despite my prior attempts to resolve the issue directly with Experian, Equifax, and TransUnion. I filed an FTC Identity Theft Report ( # XXXX ), which documents the fraudulent and incorrect items on my credit report. Despite providing the FTC Identity Theft Report and submitting disputes, these incorrect items have not been removed, which is a violation of my rights under the Fair Credit Reporting Act ( FCRA ) and related laws. Requested Resolution : I respectfully request that the CFPB : 1. Investigate the noncompliance of Experian, Equifax, and TransUnion with the Fair Credit Reporting Act ( FCRA ), Identity Theft and Assumption Deterrence Act, and other applicable laws regarding fraudulent information. 2. Ensure that Experian, Equifax, and TransUnion immediately remove the fraudulent and inaccurate and unverifiable information from my credit report, as per the FTC Identity Theft Report ( # XXXX ) and my legal rights. 3. Enforce corrective action by the credit bureaus to prevent further violations of the law regarding consumer credit report accuracy. 4. Furthermore, I am requesting written confirmation of the actions taken in response to my disputes. I am requesting full, clear and easy to read explanation of the investigation of inaccurate, fraudulent, and unverifiable information. Thank you for your prompt attention to this matter. I look forward to receiving written confirmation that the CFPB is taking action to protect my rights as a consumer and ensure that these errors are corrected immediately.
