Consumer Narrative

The following account : XXXX, is on my credit report from Credence RM. This letter serves as a complaint regarding their violation of my rights under the Fair Credit Reporting Act ( FCRA ) and other applicable consumer protection laws. I also request immediate investigation and removal of this erroneous account, as it is damaging my credit and causing undue hardship. According to the FCRA ( 15 U.S.C. 1681 ), Credence RM is obligated to ensure that any information they furnish to credit reporting agencies is accurate and verifiable. In this case, they have failed to meet these requirements. Failure to Provide Adequate Debt Validation ( 15 U.S.C. 1692g ( b ) ) I have the right to request proper validation of the alleged debt, which includes : Proof of the original creditors name and the chain of ownership of the debt. Documentation of the original signed agreement proving I owe this debt. Evidence that Credence RM has the authority to collect in Ohio while attempting to enforce this debt in New York. Simply providing a billing statement does not meet the standards of validation under federal law. This has been upheld in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, where the court held that billing statements alone are insufficient validation of a debt. Credence RM is required to ensure the maximum accuracy of the information they report. Failure to validate the debt renders the account unverifiable, making their reporting a violation of the FCRA. As per XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. XXXX ), unverifiable debts can not be reported. Under the Fair Debt Collection Practices Act ( FDCPA ), debt collectors must have proper authorization to collect debts. Credence RM has failed to provide proof that they are authorized to collect this debt in New York while I reside in Ohio. Their actions constitute misleading and deceptive practices in violation of 1692e of the FDCPA. Moreover, collection actions across state lines without proper licensing may violate New Yorks and Ohios consumer protection statutes, which require out-of-state collectors to meet specific legal requirements before pursuing debts.
