Consumer Narrative
To Whom It May Concern at the CFPB, This is my third/fourth attempt to have the following fraudulent accounts removed from my credit report. Experian and Equifax continue to auto-verify these accounts without proper investigation, violating my rights under the Fair Credit Reporting Act ( FCRA ). I have now obtained a notarized identity theft affidavit and am demanding full compliance with federal law. Fraudulent Accounts to Be Deleted Immediately : XXXX Account # : XXXX ( Experian, Equifax ) XXXX XXXX XXXX Account # : XXXX ( Equifax ) Legal Violations by Experian & Equifax : Experian and Equifax are violating the FCRA 1681c-2, which requires credit bureaus to block fraudulent accounts immediately upon receiving a valid identity theft report. Additionally, under FCRA 1681i, they are required to conduct a proper reinvestigation, which they have failed to do by relying on automated verification processes instead of contacting the actual creditors. Fair Resolution to This Issue : I am demanding the following : Immediate and Permanent Deletion of the fraudulent accounts listed above. Written Confirmation from Experian and Equifax that these accounts have been removed. Compliance with the FCRA, ensuring that all future identity theft disputes are properly investigated and resolved as required by law. A Formal Statement from Experian and Equifax explaining why these accounts were not removed in the first dispute, despite sufficient evidence of fraud. Failure to comply will result in further legal action, including potential claims under FCRA 1681n, which allows for damages of up to {$1000.00} per violation, plus punitive damages and attorney fees. I expect Experian and Equifax to resolve this matter within 15 days and provide written confirmation of the deletions.
