According to the Fair Credit Reporting Act of 1970, 15 USC 1681 section 602 ( a ) ( 4 ) states : " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' VERISK ANALYTICS INC ( IIX ) is in fact a consumer reporting agency, and I am the Consumer. Pursuant to the law, I have the right to insure my private nonpublic personal information is not shared. The Federal Drivers Privacy Protection Act of XXXX which is codified in 18 U.S.C 2721 states : ( a ) In General.A State department of motor vehicles, and any officer, employee, or contractor thereof, shall not knowingly disclose or otherwise make available to any person or entity : ( 1 ) personal information, as defined in 18 U.S.C. 2725 ( 3 ), about any individual obtained by the department in connection with a motor vehicle record, except as provided in subsection ( b ) of this section; or ( 2 ) highly restricted personal information, as defined in 18 U.S.C. 2725 ( 4 ), about any individual obtained by the department in connection with a motor vehicle record, without the express consent of the person to whom such information applies, except uses permitted in subsections ( b ) ( 1 ), ( b ) ( 4 ), ( b ) ( 6 ), and ( b ) ( 9 ). ( b ) ( 11 ) states : For any other use in response to requests for individual motor vehicle records if the State has obtained the express consent of the person to whom such personal information pertains. 18 U.S.C. 2725 ( 1 ) defines motor vehicle record and ( 3 ) personal information as : ( 1 ) motor vehicle record means any record that pertains to a motor vehicle operators permit, motor vehicle title, motor vehicle registration, or identification card issued by a department of motor vehicles ; ( 3 ) personal information means information that identifies an individual, including an individuals photograph, social security number, driver identification number, name, address ( but not the XXXX zip code ), telephone number, and medical or XXXX information, but does not include information on vehicular accidents, driving violations, and drivers status. 15 USC 1681 section 604 ( a ) section 2 which reads : " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Pursuant to FLORIDA STATUTE 119.0712, VERISK ANALYTICS INC ( IIX ), the Consumer reporting agency, must have my consent to receive or furnish this information, and I did not give them my written consent to do so. Any and all consent to VERISK ANALYTICS INC ( IIX ), whether it be verbal, non-verbal, written, implied or otherwise, I the consumer henceforth revoke. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' VERISK ANALYTICS INC ( IIX ) never informed me of my right to exercise my nondisclosure option. Not only that, 15 USC 1681C ( a ) ( 5 ) states : " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information : Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This item is an adverse item and is being reported without my permission, which violates the the Fair Credit Reporting Act of XXXX, the Privacy Act of XXXX, and the Drivers Privacy Protection Act of XXXX. This report does not reflect a conviction of any crime. 15 USC 1681s2 ( A ) ( 1 ) A states : " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC 1681e states : " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. VERISK ANALYTICS INC ( IIX ) is not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' Per the Fair Credit Reporting Act of XXXX, I am opting out of the reporting of this adverse information contained within the report from VERISK ANALYTICS INC ( IIX ) and am requesting that the information be removed from the consumer report.
