Consumer Narrative
I was a member of XXXX XXXX XXXX through XXXX, and then in XXXX of XXXX I requested my membership be cancelled at the front desk, which they told me was completed. My debit card continued to be charged by the XXXXXXXX XXXX XXXX in XXXX and XXXX, so I went to the gym to alert them of the mistake and request a refund. The staff at the desk apologized, told me it would not happen again and confirmed my account was now officially cancelled. They also told me they could not process a refund due to issues with their card system, so I would need to dispute the charges with my bank. Elements then attempted to charge my card again in XXXX which declined for insufficient funds. I called the gym to request they remove my card information from their system since they could not ensure no more charges would be made, at which point they told me it was removed and I no longer have any cards on file with them. XXXX XX/XX/XXXX XXXX XXXX XXXX closed their gyms permanently with insufficient notice for members and employees, and transferred all member accounts to their new gym called " XXXX XXXX '' about XXXX miles away. My card was then charged twice on XX/XX/XXXX totaling about {$170.00}, which they claim was owed for XXXX and XXXX dues and included a late fee for those months. I disputed the charges with my bank, and was refunded for the XX/XX/XXXX charge. I also called XXXX XXXX to speak to a manager about the ongoing charges, and the staff gave me an email address to contact regarding the issue. I contacted the email and received no response. XXXX XXXX then charged my debit card again on XX/XX/XXXX for the same amount charged in XXXX, causing me to dispute the charges again as well as completely cancel my debit card to avoid more fraudulent transactions. After many months of attempting to get a response from this business to fix the billing issues, I received a notice of collections from Aldous & Associates law firm on behalf of XXXX XXXX in the amount of {$360.00}, which is now negatively impacting my credit report. I've requested that this collection be removed from my credit report many times with no meaningful responses or cooperation, and I simply want this to stop effecting my credit score. Elements seems to have a reputation for fraudulently charging the cards of their members, documented in their poor online reviews from customers with similar stories, and they've brought that reputation with them in their rebrand to XXXX XXXX. I've seen so many stories similar to mine that this could possibly turn into a class action lawsuit.
