Consumer Narrative

Complaint I am formally disputing the fraudulent and unlawful actions taken against me by XXXX XXXX XXXX and XXXX XXXX XXXX concerning my vehicle purchase, financing, and subsequent illegal repossession. The actions of both entities constitute fraud, unlawful repossession, wrongful credit reporting, and violations of both state and federal consumer protection laws. Invalid Power of Attorney & Fraudulent Vehicle Title Assignment On XX/XX/XXXX, I purchased a vehicle from XXXX XXXX XXXX under a financing agreement with XXXX XXXX XXXX. As part of this transaction, I was misled into signing a Power of Attorney ( POA ) granting the dealership authority to act on my behalf. However, this POA was : Not notarized, nor signed with witnesses, rendering it invalid under California Civil Code Section 1189 and California Probate Code Section 4121. Used unlawfully by XXXX XXXX XXXX to list XXXX XXXX XXXX as the lienholder on my property, despite the fact that I never explicitly authorized this. Exploited by XXXX XXXX XXXX to repossess my vehicle, even though an invalid POA can not legally grant authority to transfer title or authorize repossession. Because the POA was legally invalid, XXXX XXXX XXXX had no right to repossess my vehicle, making the repossession unlawful. Failure to Provide Required Disclosures & Violations of Federal Law Both XXXX XXXX XXXX and XXXX XXXX XXXX failed to provide me with legally required disclosures, including : 1. Truth in Lending Act ( TILA ) Disclosures I was not given full transparency regarding the terms of my loan, including the total cost of financing, finance charges, or payment schedule, violating 15 U.S.C. 1601 et seq. 2. Fair Credit Reporting Act ( FCRA ) Disclosures XXXX XXXX XXXX has falsely reported negative credit information without my explicit consent or justification, violating 15 U.S.C. 1681 et seq. I did not authorize any credit reporting and did not sign any documents agreeing to the credit reporting as I was never provided with them. 3. Right to Rescind Notice I was never informed of my right to rescind the financing agreement, as required by California Civil Code 2982 ( g ) ( 1 ). 4. Gramm-Leach-Bliley Act ( GLBA ) Privacy Disclosures I was not provided with legally required privacy notices about how my personal information was being used. Pattern of Unlawful Repossession by XXXX XXXX XXXX XXXX XXXX XXXX has a documented history of unlawful repossession practices and consumer protection violations. This is demonstrated in the following lawsuits : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX settled claims related to wrongful repossession, including failure to provide required legal notices. XXXX XXXX XXXX XXXX XXXX ( XXXX ) XXXX XXXX illegally repossessed a leased vehicle and violated the FCRA and TILA by failing to provide accurate credit reporting and loan disclosures. These cases indicate XXXX XXXX XXXX ongoing pattern of misconduct, further reinforcing the unlawful nature of my vehicles repossession. Securitization & Lack of Standing to Repossess It is likely that my auto loan was securitizedbundled with other loans and sold to investorswhich raises serious legal concerns : Lack of Standing to Repossess If XXXX XXXX no longer legally owns my loan, they had no right to enforce repossession. Chain of Title Issues Under the Uniform Commercial Code ( UCC ), lenders must provide proof of ownership before enforcing a loan. XXXX XXXX has not done so. Failure to Disclose Securitization If my loan was securitized, and this was not disclosed, XXXX XXXX may have violated RESPA ( 12 U.S.C. 2605 ) and TILA ( 15 U.S.C. 1641 ( g ) ). If the Vehicle Has Been Sold After Repossession If XXXX XXXX XXXX has already sold my vehicle following this illegal repossession, I demand full financial compensation equal to the full original purchase price of the vehicle, as well as damages for the fraudulent and unlawful actions taken against me. This demand includes : 1. Full reimbursement of the total purchase price of the vehicle, including all financing costs, taxes, and fees. 2. Reimbursement of all payments made toward the vehicle, including my down payment and all monthly payments. 3. Compensation for the equity lost in the vehicle due to the unauthorized sale. 4. repossession. Payment for any penalties, fees, or outstanding balances created by the unlawful 5. Additional damages for wrongful repossession, fraudulent misrepresentation, and violations of consumer protection laws, including : FCRA violations for improper credit reporting. TILA violations for failure to provide required disclosures. Violations of Californias Rees-Levering Motor Vehicle Sales and Finance Act ( California Civil Code 2981 et seq. ), which regulates the repossession and sale of financed vehicles.
