Consumer Narrative

Dear XXXX Dispute Department, I am writing to formally dispute the fraudulent accounts that remain on my XXXX credit report despite my repeated efforts to have them removed. I have provided substantial evidence proving that these accounts were opened as a result of identity theft, yet XXXX has conducted an inadequate investigation and failed to remove them. This directly violates the Fair Credit Reporting Act ( FCRA ) and has caused me ongoing financial and personal hardship. Background I have been a victim of identity theft since XXXX and have taken extensive steps to document and address this issue. On XX/XX/XXXX, I discovered once again that multiple fraudulent accounts and unauthorized inquiries had appeared on my credit report. In response, I : 1. Filed a police report On XX/XX/XXXX, I filed a police report with the XXXX Police Department , officially documenting the identity theft. 2. Submitted an Identity Theft Report On XX/XX/XXXX, I completed and submitted an Identity Theft Affidavit. 3. Reported the fraud to XXXX I formally disputed the fraudulent accounts with XXXX and provided supporting documentation, including my police report and Identity Theft Affidavit. 4. Placed a fraud alert on my credit reports I requested that XXXX place a fraud alert on my file to help prevent further fraudulent activity. Despite my compliance with the proper dispute process and providing clear evidence of fraud, XXXX wrongfully verified the fraudulent accounts as accurate and has refused to remove them. Fraudulent Accounts Still Reporting on My XXXX Credit Report The following fraudulent accounts remain on my XXXX report and must be removed immediately : XXXX XXXX XXXX ( XXXX accounts ) XXXX XXXXXXXX XXXX XXXX These accounts were fraudulently opened in my name, and Experians failure to remove them after a proper dispute violates my rights under the FCRA. Experians Violations of the Fair Credit Reporting Act ( FCRA ) Experians refusal to remove these fraudulent accounts after a documented dispute violates multiple provisions of the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681i, including : 1. Failure to Conduct a Reasonable Investigation ( 1681i ( a ) ( 1 ) ( A ) ) The FCRA mandates that credit bureaus conduct a reasonable reinvestigation when a consumer disputes inaccurate information. Given that I have provided a police report, Identity Theft Affidavit, and other supporting documentation, XXXX has failed to meet this legal obligation by continuing to report fraudulent accounts as valid. 2. Failure to Delete Inaccurate or Unverifiable Information ( 1681i ( a ) ( 5 ) ) The FCRA requires credit bureaus to remove or correct information that is inaccurate, incomplete, or unverifiable. The fraudulent accounts I have disputed meet these criteria, yet XXXX has wrongfully allowed them to remain on my report. 3. Failure to Properly Address Identity Theft Claims ( 1681c-2 ( a ) ) Under the FCRA, when a consumer provides an official police report and Identity Theft Affidavit, the credit bureau must block fraudulent information from appearing on the report. XXXX refusal to comply is a clear violation of this rule. CFPB Complaint and Further Action Due to Experians failure to correct my report, I filed a complaint with the Consumer Financial Protection Bureau ( CFPB ) on XX/XX/XXXX. However, these fraudulent accounts still remain. If XXXX does not immediately remove these accounts, I will escalate this matter further, including pursuing legal action for noncompliance with the FCRA. Requested Action I demand that XXXX take the following corrective actions immediately : 1. Delete all fraudulent accounts listed above from my credit file. 2. Provide a written statement confirming the removal of these accounts. 3. Ensure that no further fraudulent activity linked to my identity appears on my credit report. I have enclosed copies of all relevant documentation, including my police report, Identity Theft Affidavit, CFPB complaint, and prior dispute correspondence. Under the FCRA, XXXX is legally required to respond and resolve this dispute within 30 days. Failure to comply will result in further legal action to enforce my rights. I expect XXXX to uphold its legal responsibilities and rectify this matter immediately. Sincerely, XXXX XXXX Enclosures : Police Report ( XX/XX/XXXX ) Identity Theft Affidavit ( XX/XX/XXXX ) CFPB Complaint ( Filed XX/XX/XXXX ) Prior Dispute Correspondence with XXXX
