Consumer Narrative
After carefully reviewing my consumer report on this inaccurate account XXXX ( Account XXXX ), I noticed a late payment, this is inaccurate and is being reported. After closely looking at the Fair Credit Reporting Act, I have made note of violations made in handling the account and thereafter my dispute. Not only is the account billing error but are reporting an erroneous late payment. There are multiple violations in handling this dispute that are clearly outlined in the FCRA within law 15 USC1666. I would like to bring your attention to 15 U.S. code 1666- CORRECTION OF BILLING ERRORS, and blatant violations within these codes.15 U.S. Code 1666 ( a ) failed to acknowledge my dispute within 30 days of receiving it, as required, and 15 U.S. Code 1666 ( b ) failed to provide the results of their investigation within two billing cycles or a maximum of 90 days. Then 15 U.S. Code 1666a ( a ) reported the disputed late payment to third-party credit bureaus before resolving the dispute, which is a direct violation of the law. Also 15 U.S. Code 1666a ( b ) failed to notify me of the names and addresses of the third parties to whom you reported the delinquency while it was in dispute. 15 USC 1666b - timing of payments, the law clearly states : ( a ) Time to make payments, a creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose regarding the items above having late payments, it is important to note that those are to be excluded from a consumer report as well, per 15 USC 1666b , so there are various violations your agency is committing by willingly continuing to report this information. Under these laws, you are required to thoroughly investigate disputes, ensure accurate reporting, and maintain compliance with consumer protection standards. By continuing to report the inaccurate late payment, you are not only violating these regulations but also causing harm to my credit standing. To resolve this matter and avoid further action, I demand that you : Immediately correct the account ( by updating it to " Paid as Agreed '' ), and provide written confirmation of the update and your compliance within 30 days of receipt of this notice.
