Consumer Narrative
I'M NOT SURE OF THE EXACT DATE BUT IT WILL SHOW ON MY CREDIT REPORTING FILE. I'VE SENT MANY LETTERS TO THE COMPANIES AND THE CREDIT AGENCIES, NOTHING CHANGES. I am writing to formally dispute the accuracy of certain negative items on my credit report. It has come to my attention that these items are not only impacting my credit score significantly but are also reported in violation of federal law. Specifically, I am referring to the late payment reported on XXXX Bank account numbers XXXX, XXXX, and XXXX. Also XXXX XXXX accounts XXXX, XXXX. XXXX XXXX account XXXX. I would like to dispute all negative items on my report every one of them if not listed above. According to 15 USC 1666B ( a ), under the law passed by Congress, " A creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose. '' The reported late payment is a result of an accidental oversight, and based on the aforementioned law, this item should not have been reported as late. I request that you investigate this matter and remove the inaccurate negative information from my credit report. Also, according to 15 U.S. Code 1666B - Timing of payments** ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due. If an open-end consumer credit plan provides a time period within which an obligor may repay any portion of the credit extended without incurring an additional finance charge, such additional finance charge may not be imposed with respect to such portion of the credit extended for the billing cycle of which such period is a part, unless a statement which includes the amount upon which the finance charge for the period is based was mailed or delivered to the consumer not later than 21 days before the date specified in the statement by which payment must be made in order to avoid imposition of that finance charge. Article I, Section 10 of the United States Constitution**, which states : " No State shall make any Thing but gold and silver Coin a Tender in Payment of Debts. '' This means that states are prohibited from making anything other than gold and silver coin a legal tender for the payment of debts. Please conduct a thorough investigation and correct the inaccuracies promptly. I look forward to your swift response and resolution of this matter, as per the Fair Credit Reporting Act ( FCRA ). Thank you for your attention to this request. Sincerely,
