Consumer Narrative

Complaint Subject : Demand for Deletion of Charge-Off Account ( s ) Due to Violations of FCRA and XXXX XXXX XXXX XXXX Name ( or Company Involved ) : Equifax and XXXX Account Number ( XXXX ) : XXXX. XXXX XXXX XXXX, Account Number : XXXX XXXX. XXXX XXXX XXXX, Account Number : XXXX Complaint Details : I am filing a formal complaint against Equifax and XXXX for violating my rights under the Fair Credit Reporting Act ( FCRA ) and the Truth in Lending Act ( TILA ) regarding charge-off accounts listed on my credit report under XXXX XXXX XXXX XXXX These accounts were successfully deleted from my credit report by XXXX, indicating that the information was either inaccurate or unverifiable. However, Equifax and XXXX continue to report these charge-offs despite multiple disputes and requests for proper verification. This failure to delete the accounts or provide valid documentation constitutes clear violations of the FCRA and TILA. Violations of the Fair Credit Reporting Act ( FCRA ) : 1. FCRA Section 1681b ( 2 ) - Accuracy of Information : The FCRA mandates that only accurate information is reported about consumers. The credit reporting agencies failure to provide proof of verification for the charge-off entries under XXXXXXXX XXXX XXXXXXXX violates my rights to an accurate credit report. Without proof, these charge-offs remain incorrectly reported and are damaging my credit. 2. FCRA Section 1681b ( 5 ) - Permissible Purpose : Under this section, information in a consumer report must be accurate and used for a permissible purpose. These charge-offs violate this section because there is no valid documentation to support their accuracy or permissibility. 3. FCRA Section 611 - Duty to Investigate : Section 611 requires that a thorough investigation be conducted for any disputed information. Despite my requests, Equifax and XXXX failed to properly investigate the charge-offs, and as a result, inaccurate information continues to be reported. 4. FCRA Section 1681i - Reinvestigation Failure : Section 1681i requires that, upon dispute, the credit reporting agency must complete a reinvestigation within 30 days and remove inaccurate information if it can not be verified. The fact that XXXX has already deleted these accounts further demonstrates the failure of Equifax and XXXX to properly reinvestigate and delete these charge-offs. Violations of the Truth in Lending Act ( TILA ) : Under TILA, creditors are required to provide accurate and timely information regarding loans, charge-offs, and account statuses. The failure to properly report and verify these charge-offs under TILA is a clear violation, as charge-offs should only be reported accurately and substantiated. Request for Resolution : 1. Immediate delet ion of the charge-off entries from my credit report under FCRA Sections 1681b ( 2 ), 1681b ( 5 ), 611, and 1681i and TILA. 2. Proof of verification from the creditor to substantiate the charge-offs. If the creditor can not provide satisfactory documentation, the accounts must be removed from my credit report immediately. XXXX. A thorough investigation into this matter and correction of any incorrect information on my credit report in compliance with FCRA and TILA requirements. Final Notice : If these charge-offs are not deleted from my credit report or properly substantiated within 15 days, I will be forced to pursue further actions, including but not limited to filing complaints with the Consumer Financial Protection Bureau ( CFPB ) and seeking legal recourse for violations of the FCRA and TILA. I request that the CFPB assist in ensuring that my rights are protected and that the incorrect information is removed from my credit report. Thank you for your prompt attention to this matter. Sincerely, XXXX XXXX
