This creditor has used false, misleading and deceptive means to report the credit card account to my personal consumer profile, and to Credit Reporting Agencies. The account information reportig has multiple inaccuracies, and violations of multiple laws, acts, and regulations. XXXX XXXX has reported the last payment to the account on XX/XX/XXXX, and the date it was closed XX/XX/XXXX. The current payment status is " Derogatory ''. Although the account is a " charge off ''. The creditor continues to report " late payments '' as recent as XX/XX/XXXX. The reporting of any transaction history, without written consent from the consumer, is in violation of the Privacy Act of XXXX. Although the creditor has charged off the account, which is reflected in my consumer profile, the creditor continues to report adverse items. The account has been sold to a XXXX party, without proper disclosure to me from the original creditor ( XXXXXXXX XXXX ). A charge off is a XXXX time event, and because it is the creditor should not be repeatedly reporting/continuously updating my personal consumer profile and reporting to Credit Reporting Agencies . These actions have and continue to incur damage to me on a monthly basis violating 15 USC 1681e ( b ) by misleading and inaccurate reporting. Also because the 3rd party purchaser of the charge off account and original creditor are reporting the same account " derogatory status and late payments '', the impact to my personal consumer profile is two-fold damaging, in violation of 15 USC 1681e ( b ) by not ensuring accurate representation of a debt obligation, 15 USC 1681s-2 ( a ) which prohibits misleading or duplicate reporting and 15 USC 1692e ( 8 ) communicating false credit information. The charge off by this creditor ( XXXX XXXX ) is required, by IRS guidelines to issue a XXXX for cancellation of debt over XXXX which has not been recieved to date.
