Notice of Revocation of Consent and Demand for Compliance with Federal Law To Whom It XXXX Concern : This is a formal notice invoking my rights under federal law regarding the use, furnishing, and reporting of my private information by XXXX, XXXX, Transunion and any financial institutions or furnishers of information to consumer reporting agencies ( hereinafter referred to as Furnishers ). I. Consumer Rights Under the Fair Credit Reporting Act ( FCRA ) Pursuant to the Fair Credit Reporting Act ( FCRA ), codified at 15 U.S.C. 1681, Congress explicitly recognized the necessity for consumer reporting agencies to execute their responsibilities with fairness, impartiality, and respect for consumer privacy rights ( 15 U.S.C. 1681 ( a ) ( XXXX ) ). XXXX, Transunion and XXXX are defined as consumer reporting agencies under the FCRA, and I, as the consumer, am entitled to protections under this statute. Under 15 U.S.C. 1681b ( a ) ( 2 ), a consumer reporting agency may furnish a consumer report only with the explicit written consent of the consumer to whom the report pertains. I have not provided, nor do I intend to provide, such written consent to XXXX, XXXX, Transunion, or any Furnisher of information. Accordingly, any implied, verbal, non-verbal, or otherwise assumed consent is hereby revoked. XXXX. Privacy Obligations Under the Gramm-Leach-Bliley Act ( GLBA ) The Gramm-Leach-Bliley Act, codified at 15 U.S.C. 6801, mandates that financial institutions respect the privacy of their customers and protect the security and confidentiality of nonpublic personal information. Under 15 U.S.C. 6802 ( b ) and ( c ), financial institutions are prohibited from disclosing nonpublic personal information to nonaffiliated third parties unless consumers are provided with a clear explanation of their right to opt out of such disclosures. I have not been informed of my right to opt out of such disclosures, nor have I been provided with the opportunity to exercise this right. This constitutes a violation of federal law. I am now exercising my opt-out rights in accordance with 12 C.F.R. 1016.7, which states that consumers may exercise their right to opt out at any time. III. Restrictions on Reporting Adverse Information Pursuant to 15 U.S.C. 1681c ( a ) ( 5 ), consumer reporting agencies are prohibited from including adverse items of information in consumer reports if such information is older than seven years, except for records of convictions of crimes. Any adverse information reported by XXXX or XXXX that falls outside this statutory timeframe is unlawful. IV. Furnishing of XXXX XXXX XXXX 15 U.S.C. 1681s2 ( a ) ( 1 ) ( A ), no person or Furnisher shall provide information to a consumer reporting agency if they know or have reasonable cause to believe that such information is inaccurate. Additionally, consumer reporting agencies are required by 15 U.S.C. 1681e to implement and maintain reasonable procedures designed to ensure compliance with 1681c and limit the furnishing of consumer reports to permissible purposes under 1681b. XXXX and XXXX have failed to meet these statutory obligations. XXXX Demand for XXXX XXXX XXXX on the foregoing : XXXX. I hereby revoke any and all consentwhether verbal, written, implied, or otherwisefor XXXX, XXXX, Transunion or any Furnisher of information to disclose, furnish, or report my private information. XXXX. I am exercising my opt-out rights under 12 C.F.R. 1016.7 and demand immediate cessation of the sharing, furnishing, or reporting of my nonpublic personal information. 3. I demand the removal of any adverse items of information that violate 15 U.S.C. 1681c ( a ) ( 5 ). 4.
