This is a formal complaint against PHH, following receipt of correspondence dated XX/XX/year>, received by my person, via USPS, on XX/XX/XXXX and to which I am submitting this response/refutal, the basis of this complaint. The reason for the response/refutal is that said correspondence includes continued, on the part of PHH, misrepresentation of facts, inaccuracies and misleading information, all to the detriment of my person, the borrower, and family. I thank you for the time you spent in responding, well over a month, however, the source ( s ) that provided you with information is/are void of verifiable facts and objectivity. This response is consistent and supports prior borrower responses and submissions. This response/refutal clearly presents the facts, all supported by PHH Mortgage Services-generated/issued ( PHH ) documents, all that unquestionably place the responsibility of this situation squarely on PHH, following their violation of notification requirements as required by its own, state and national laws and regulations governing mortgage servicers and further compounding the situation by treating it as if it was the borrowers fault, attempting to free itself from its self-imposed liability and errors. PHH has acknowledged, in writing, in its XX/XX/year> correspondence, that it clearly violated and did not comply with its Temporary Hardship Forebearance Plan Agreement, stating, We acknowledge that no call-out attempts were made to contact the borrower before the end of the plan. Further, PHHs attempt to disengage from its acknowledgement of violation and non-compliance by referencing a XX/XX/year>XXXX correspondence, is disingenuous and totally misleading as the referenced correspondence was mailed to a third-party that is not a party to the account/mortgage and not personally liable for the same.
