Consumer Narrative
Dear Consumer Financial Protection Bureau, I am writing to urgently request an immediate investigation and the deletion of two credit accounts managed by Midland Credit Management ( MCM ), which are reported on my XXXX credit file. These accounts have consistently been reported inaccurately despite my multiple payments and disputes, in direct violation of the Fair Credit Reporting Act ( FCRA ). I believe these actions constitute violations of FCRA sections 611 ( Procedure in case of disputed accuracy ) and 623 ( Responsibilities of furnishers of information ), which mandate accurate information reporting and a thorough investigation of disputes. Details of the Violations : Incomplete and Incorrect Payment Reporting : Account Number XXXX ( XXXX payment not reported ) and XXXX ( XXXX payment not reported ) Despite my regular bi-monthly payments, MCM has failed to report several payments and inaccurately shows {$0.00} payments for months where I made multiple payments. Notably, in XX/XX/year>, I made three payments which are not reflected accurately. This misreporting has significantly impacted my credit score and financial standing. Several months are listed as id I have made no payment that month and I have made 2. My original balance and and my current balance are remaining the same no matter how many payments are listed which is inaccurate reporting. I paid XXXX on both accounts in XXXX and I was advised I would not be debited based on the original agreement and they still attempted to debit my account. I was told this was for a credit card but they are unable to tell me what was the original credit limit on either account. I have requested the original contract for the account and they stated they don't have that information. I have never entered into any contract with Midland and I am unsure how I owe them directly. Or how they have my personal information but not original balances Failure to Investigate Disputes : XXXX has not conducted a thorough investigation of my disputes concerning these inaccuracies. My requests for an investigation are consistently met with generic responses stating that the information has been " verified '' without any evident review or correction of the reported data, violating FCRA section XXXX. I am told to visit the XXXX site but the site is where i identified the discrepancies. I have called 6 times today but the automotive systems is not accepting my social and zip then refers me to the website and hangs up. Unauthorized Debt Sale and Lack of Contractual Documentation : I have never authorized the sale of any debt to MCM, nor have I ever entered into a direct contract with them. Requests for the original contractual documents have been ignored, which questions the legitimacy of the debt claim itself, violating principles under FCRA section 623. Privacy Violation : The transfer of my debt without my consent also likely violates privacy protections under the FCRA and other consumer laws, which guard against unauthorized sharing of personal financial information. Given the severity and persistence of these issues, I request the CFPB to intervene directly to ensure that : The two accounts ( XXXX and XXXX ) are thoroughly investigated and subsequently deleted from all my credit reports due to severe reporting inaccuracies and failure to provide requisite documentation. Immediate corrective action is taken by XXXX to rectify their dispute investigation processes. Attached are all relevant documents, including payment records and correspondence records with MCM and XXXX, evidencing my claims. Given the clear breach of federal regulations and the significant impact on my personal and financial life, I expect prompt action to resolve these inaccuracies. Thank you for your immediate attention to this grave matter. I will attach a letter with XXXX 's response to my XXXX dispute. They do not review the letters and state they can not locate my credit file and it did not appear to come from me. I was indeed the person who sent the dispute via mail and I have filed the same online. All of my efforts have been unsuccessful. I attempted to update my current address with XXXX with a representative and she intern added another incorrect address to my profile.
