My auto loan was charged off between XX/XX/XXXX and XX/XX/XXXX, then reported to the XXXX credit agencies as a charge off, when I inquired about the reason for the charge off the creditor XXXX stated they reserve the right above federal policy guidelines to charge off an account basically after non payment or expectation there of min of 120 days consecutive or non consecutive combined throughout the loan period or calendar year. XXXX. Delinquency Periods : XXXX, usually report delinquencies in increments30 days late, 60 days late, 90 days late, and so forth. If My account was reported as 30 days late on XX/XX/XXXX and after that remained current as agreed for the next ten months until XX/XX/XXXX or XX/XX/XXXX as reported on Experian credit reports for the last XXXX plus years it would suggests that there were no further delinquencies reported after the date of XX/XX/XXXX, If fair credit reporting policy is followed or based off of Where is the 120 days delinquency or No funds recovered or received not to mention the issue that the creditor XXXX stance that they had the expectation that recovery of funds was unlikely. This is confusing because as reported in XXXX report dated and furnished XXXX reported they had confirmed and tracked payment being sent from XXXX XXXX XXXX in XX/XX/XXXX so the question of whether the creditor has a claim that payment recovery is unlikely draws a significant difference of opinion My question is for consecutive reporting cycles and requested investigations submitted to Experian Credit Agency and the CFPB who is reviewing these responses given by the creditor regarding how they implement charge off reporting, protect the consumer from creditors functioning as is or at will.
