Consumer Narrative

My XXXX account was disputed and is negatively reporting as unpaid on my consumer report with Experian. Experian and XXXX did not correct my account. They did not update my payment history or payment status as paid to my consumer report file. My account is paid in full but is reflecting a 60 day past due balance of {$81.00} for XXXX last recent payment with XXXX was on XX/XX/XXXX in the amount of {$30.00} and {$51.00}, which satisfied my payment obligations under my XXXX contract. This information is not current on the consumer report but is reflecting a payment from XX/XX/XXXX in the amount of {$41.00}. Also, my payment history is reflecting 14 months instead of 12 months as outlined in my XXXX loan contract. The negative reporting of the payments history from XX/XX/XXXX thru XX/XX/XXXX is incorrect. Also, my account is supposed to go into a positive history XXXX/XXXX although it has been 100 percent paid off as of XX/XX/XXXX. There are serious violations of the FDCPA, California consumer laws violations and Metro 2 violations associated with this account such as the followings : FDCPA Violations ( 15 U.S.C. 1692 ) Misrepresentation of the Debt Reporting a balance of {$81.00} past due for XX/XX/XXXX when the account is fully paid off is a deceptive practice. This violates 1692e ( 2 ), which prohibits false or misleading representations about the amount or legal status of a debt. Unfair Practices ( 1692f ) Continuing to report a balance and negative payment history when the account has been paid in full is considered an unfair and unconscionable collection practice. Metro 2 Compliance Violations Payment Status Metro 2 guidelines require that once an account is fully paid, the payment status must be updated to " Paid in Full '' or " Closed. '' Failing to do so is a breach of Metro 2 reporting standards. Payment History Timeline Reporting 14 months of negative payment history instead of the agreed-upon 12 months violates the guidelines for accuracy and consistency. Metro 2 requires historical information to be reported precisely according to contract terms. Current Balance The Metro 2 standard for reporting closed accounts requires the balance to be updated to {$0.00} when fully paid. Reporting {$81.00} as past due violates this requirement. Timely Reporting of Positive Status Metro 2 mandates that future statuses or changes to the account ( e.g., transitioning into positive history by XXXX/XXXX ) be reflected accurately and on time. California Consumer Laws California XXXX Fair Debt Collection Practices Act ( California Civil Code 1788 ) California law prohibits misrepresenting a debt 's status. Reporting the account as past due after payment violates California consumer protection laws. California Consumer Privacy Act ( CCPA ) Failing to ensure accurate reporting and securely manage your payment data could result in a violation of your privacy rights.
