On XX/XX/year> my car was repossessed, not due to me not making payments. It was due to XXXX XXXX XXXX not giving me prior notice about a transfer and Peritus Portfolio Services for not given me proper notice of the transfer. I attempted to make a payment on XX/XX/year> on my auto loan through XXXX portal with XXXX XXXX but the portal wasnt working. I call the finance company XXXX XXXX and the number was out of service. I then call the dealership XXXX their number wasnt working. So i check my email and saw a message posted on XX/XX/year> bout my account is being transfer to Peritus and that the company had file for bankruptcy and had a number provided. I call the number provided to inquire about my account with them since the email stated i should had received a letter within 2 weeks of XX/XX/year> but didnt get any notice. So the guy ask me to verified some info once verified I ask him can he give me my account info and the link to make payment since I couldnt make a payment with XXXX XXXX payment portal. The guy told me he couldnt help me and that in fact i reach the wrong dept so he place me on hold to transfer me to customer service. After 10 mins he said nobody pick up so he was goin to place a note saying am looking for letter and payment info. After 2 weeks went by I call again to Peritus on XX/XX/year> to see what was goin on because i still didnt receive the letter or hear back and my account is now about to be 2 months late. Sound like the same guy answered the phone and it was the same scenio. I ask the guy can he give me the correct number so I wont be calling the wrong dept but i was rushed off the phone. So I was instructed to wait for the letter. And i never got that letter. So from that time after XXXX i been looking for legal help with my situation because I couldnt understand how the guy can veirfied my info but coudnt provide me with the account number, payment info or even tell me when the letter was exactly mail to me. I recheck my my email and I saw it was an letter attach to the XX/XX/year> email saying that XXXX XXXX XXXX was forwarding their number to Peritus number. That right there had red flag up for me because I look up was it legal for one business to merge their number to another business. And it stated it only legal if it within the same company and XXXX XXXX and Peritus is not the same company. So I did call back before the auction date of XX/XX/year> to make arrangement to pay the past due balance off but I never received info from Peritus about the transfer so I didnt feel comfortable sending my money to them. On XX/XX/year> I requested for the contract with Peritus and XXXX XXXX since Peritus mention the transfer was court ordered I requested for the info to for clarification, payment history from XXXX XXXX. And none of the requested documents was send to me. XXXX end up sending me a bill collector letter which is not the same as the transfer service of letter. And as of today my car havent been sold after it was stated that it was being auction off at a private sale on XX/XX/year>. I havent received any further correspondence from XXXX since XX/XX/year> of the bill collector letter. I believe both companies shown lender liability by breach of contract, wrongfully repo of my car, negligent, confusing communication, fiduciary relationship, and loan packing. I will attach 2 documents that was provided and please let me know if any of these documents are a valid and correct transfer of service letter. I would like to also add that request to opt out of SMS or text communication to XXXX XXXX XXXX so by Pertius saying I receive a text from the company will violate my rights of text communication because I ask them to stop communicating through text messages. Oh and I had find out that the car dealership and finance company are one company because they do in house finance. Thank you for your time.
