Consumer Narrative
Discover Financial Services [ Discover Address Subject : Request for Investigation and Removal of Inaccurate Credit Reporting Due to Identity Theft Dear Sir/Madam, I am writing regarding an account associated with my name and Social Security number that is inaccurately being reported on my credit report. I have disputed this account with you previously, but you responded by stating that the account information is accurate and belongs to me. I am informing you again that I am a victim of identity theft, and someone unlawfully used my personal information to open this account. Furthermore, they redirected all correspondence to an address that is not mine. I have attached a copy of the identity theft report for your reference. As per the Fair Credit Reporting Act ( FCRA ), specifically 15 U.S.C. 1681c-2, once a consumer notifies a creditor or reporting agency of identity theft and provides documentation, the account must be blocked or removed from credit reporting within four ( 4 ) business days. Despite this legal requirement, the account continues to be inaccurately reported on my credit report. Here are the critical points regarding this matter : Fraudulent Account : The address linked to the account is not mine, nor is it listed on my credit report. I have never received, used, or activated a Discover card. Charged-Off and Written-Off Account : According to my credit report, the account has been charged off and written off. If the debt was indeed written off and Discover claimed a tax deduction for the amount, you would be required by the IRS to provide me with a Form 1099-C. Failure to do so implies that the reporting of a balance owed is inconsistent and a violation of FCRA standards for accurate reporting. Violation of FCRA : Reporting inaccurate information on my credit report constitutes a violation of the FCRA. This continued reporting of an account I neither opened nor used, combined with the lack of a Form 1099-C, infringes on my rights and could expose Discover to legal liabilities, including damages. Unfair Tax Implications : If the debt were written off and considered taxable income, it would be unjust for me to pay taxes on income related to a fraudulent account I did not open or use. Under the FCRA, I am requesting the following : That Discover permanently remove and delete this fraudulent account from my credit report. That you cease all reporting of this account to any credit reporting agency. Written confirmation that you have taken these steps to rectify the issue. I trust that Discover will act in good faith to comply with federal laws and correct this error. If no action is taken, I will have no choice but to seek legal recourse to protect my rights and hold Discover accountable for any violations of the FCRA.
